Religious Institutions NO MORE in the draft constitution???

The current constitution says;
78. (1) Except with his own consent, no person shall be hindered in the enjoyment of his freedom of conscience, and for the purposes of this section that freedom includes freedom of thought and of religion, freedom to change his religion or belief, and freedom, either alone or in community with others, and both in public and in private, to manifest and propagate his religion or belief in worship, teaching, practice and observance.
(2) Every religious community shall be entitled, at its own expense, to establish and maintain places of education and to manage a place of education which it wholly maintains; and no such community shall be prevented from providing religious instruction for persons of that community in the course of any education provided at a place of education which it wholly maintains or in the course of any education which it otherwise provides.

In the proposed draft constitution of Kenya 2010 - it says;

32. (1) Every person has the right to freedom of conscience, religion, thought, belief and opinion.
(2) Every person has the right, either individually or in community with others, in public or in private, to manifest any religion or belief through worship, practice, teaching or observance, including observance of a day of worship.
(3) A person may not be denied access to any institution, employment or facility, or the enjoyment of any right, because of the person’s belief or religion.
(4) A person shall not be compelled to act, or engage in any act, that is contrary to the person’s belief or religion.

Does this mean religious institutions of education including some universities are now expunged from the constitution and not recognised? And what happens to religious institutions that want to establish new educational institutions? I am a layman in this, somebody please educate me.

@masukuma . . . if a professing Christian studies Islamic Law and attains relevant qualification, can they become a Kadhi?

Kadhis’ Courts
170. (1) There shall be a Chief Kadhi and such number, being not fewer than
three, of other Kadhis as may be prescribed under an Act of Parliament.
(2) A person shall not be qualified to be appointed to hold or act in the
office of Kadhi unless the person—
(a) professes the Muslim religion; and
(b) possesses such knowledge of the Muslim law applicable to any
sects of Muslims as qualifies the person, in the opinion of the
Judicial Service Commission, to hold a Kadhi’s court.
