See Article 17 of the Transitional Provisions a the back of the Draft Constitution:

"Within five years after the effective date, the national government shall restructure the system of administration commonly known as the provincial administration to accord with and respect the system of devolved government established under this Constitution"

Note that this provision does not provide for the abolishing of the provincial administration - and it leaves open the manner in which such administration is to be restructured. I foresee a situation where the provincial administration will co-exist (and possibly conflict) with county governments for quite a while.

Local authorities will also continue to exist "subject to any law that might be enacted" - Article 18 of the Transitional Provisions.

Inconsistencies are popping up like mushrooms in cow pen.

Omtata took us through spelling issues, as well as reference to non exixstent section by the proposed constitution.

According to the Draft, the County Governments are separate entities from the local authorities. There will be lots of confusion and power struggles between the 2 at least in the initial years especially coz both of them will be raising their revenues (apart from the allocation to counties by the national govt) from the same sources. And the Draft does not have a word as to how the two institutions will co-exist (for whatever period that will be).

Then of course you will have power struggles between the PCs, DCs and DOs (and these are now so many since every village now has a district or division) on the one hand and the County Governments on the other.

The point made is simple - We could have had a better draft and it would not have taken much to clarify and add more details on matters that will obviously bring confusion. Why should we go into confusion eyes wide open?
