She could win legally but she can't win morally. A judge just like Caesars wife should be beyond reproach. So either way she is finished.

Remember Kakethi's case and many more. She was judged, convicted and jailed in public opinion. Lakini reality was very different.

Kwanza that paper trail is going to make it much more difficult for the prosecution to prove their case.

The Case is already proven. She is a thief in the court of public opinion but she will be released by her type in the corridors of injustice.

That case is still in court. With judges like Mwilu, the case will never get a hearing. Just like NYS1 the real culprits walk among us while we prosecute the innocent in the court of public opinion.

On March 16, 2016 — a few months before she joined the Supreme Court — Mwilu allegedly bought a parcel of land LR3734/1129 from Mutunga and Company, a firm associated with ex-CJ Willy Mutunga, for Sh2.8 million.
She also worked here. Nothing wrong with this problem would be if she did not declare this piece

Quote:
However, hardly two months after the purchase, the judge received Sh75 million from Forest Japan Hospital and 74 million from an unknown entity, allegedly from the sale of the same piece of land.
"Theoretically, this imply that the subject bought the property at the price of Sh2.8 million on 16/3/2016 from Justice Mutunga's company and sold it at a price of Sh75 million to Forest Japan Hospital and Sh74 million to another unknown entity," documents by DCI detectives read.
Anything wrong with this? I do not know, unless Forest Japan Hosp did not pay that money.

Quote:
According to the analysis of the bank transactions, Mwilu paid Sh15 million to Kibwezi West MP Patrick Musimba in 2013, which she told detectives was a refund for failed purchase.

However, detectives noted that there was no evidence of any payment from the MP to Justice Mwilu.

At around the same time, Musimba's election had been nullified by Justice Majanja following a petition by former lawmaker Kalembe Ndile.
Looks like she was paid for some service if the case went to the court of appeal, then she refunded the money after the high court ruling went in favor of Musimba

Starting to look like the DPP actually has some serious dirt on this mama. I thought it was a witch-hunt until she said that it is payback for the presidential election ruling. Why would she make that comment unless it's to cover up?

BBI will solve it

Maybe the 75M could be a way of obtaining kickbacks for rulings... Have someone’s whose case you’re ruling on pay you by buying your land at a predetermined price point.

Reminds me of Pirates of the Horn of Africa and how they were buying 1/4 of an acre in Eastleigh at ksh 100 million while the true worth was just 20 million.

Double sale of a plot to two different entities and no one went to court for redress (read refund and compensation)

Isolite. Musimba had actually paid air to Mwilu for the aborted purchase and hullah, it turned into cash!

A serious pirate. The legion of lawyers surely tell a story. Let me comb the Imperial bank thread .... plus the emails revealed by substandard.

The Sack of Imperial Bank: Part 2 http://owaahh.com wrote:
At 6:03 pm on 5th April, 2012, someone sent an anonymous email to Central Bank, the National Police, the Ethics and Anti-Corruption Commission, the judiciary, the Financial Post, Royal Media, and about 10 others. The subject line was “Imperial Bank Frauds & Scandals.“

Sent from imperialbankstaff@gmail.com, the email detailed different layers of scandals going on within the bank. The sender clearly had enough insider knowledge to know about 8 accounts that had received unsecured loans. He or she also mentioned that ‘the MD has secret funds abroad consisting of these embezzled funds.’ In one short, clearly hurriedly written email, the whistleblower suggested, without knowing, the three main layers of what had been happening at the bank for a decade: the black hole, Thailand, and the chama.

Standard 2/9/2018 wrote:
In December 2013, just weeks after she had recommended Justice Mwilu to be considered for appointment as a non-executive director at the bank, Mehbooba shared with her experience of a recent visit to Thailand. “Dear Justice Mwilu, please attached below, various correspondence for my trip to Thailand. The hotel we stayed at Bangkok was called Ariyasom Villa and the place on the beach that I was speaking off, is Koh So Mui,” Mehbooba writes.

See if you google the above what you get. I sent an email to my travel agent (copied below), giving them feedback on the trip after that I thought you will appreciate also. Regards and we talk soon,” she adds.

Justice Mwilu responded in a one line sentence saying she will contact the travel agent. “Thanks gal, this looks exiting (sic). Will give Peter a call and tell you all,” Mwilu responds. Peter is the travel agent.

Abdulmalek kept a list of special loans. One sheet within the list was clearly marked CBK loans. He didn’t keep the names, just what looked like codes he gave his loanees. He was paying off people within the bank by giving them money when they needed it, but with strings attached. He never really expected the money back, people in his position never really do, but he expected them to pick his calls even if it was after midnight. If money was flowing their way, they were his to control.

An email submitted in Court between IBL’S CFO and a senior manager gives a clue of how high the mess went, and how ridiculously reckless it was. In it, Kaburu, the CFO, asks the manager to delete some entries from the top 50 borrowers list. The contents of that list, crucial for every bank or any group that handles loans, changes depending on where in the files you find it. The one that made it to the board is not the one that ends up on the CBK side.

There was almost nothing suspicious to this email at first but a quick connection of who exactly Nancy Ndungu is, and who her husband was at the time, changes everything. Nancy Ndungu is Prof. Njuguna Ndungu’s wife. At the time this email conversation was happening, the professor was the head of Central Bank

Judiciary needs some deep cleansing

Quote:
Investigators from the National Intelligence Service are trying to piece together a case linking a senior judge to a counterfeit currency syndicate.

A team from the Transnational Organised Crime Unit and the police arrested Arafat Omar, alias Omar Rashid (a Kenyan), and Fidel Ako (a Ghanaian) on Monday and yesterday, respectively. The two were also charged.

Police were allowed to continue interrogating Omar. Ako, who was charged with various offences, including money laundering, was released on Sh200,000 cash bail. There are valid deportation orders against Ako.

But perhaps the most surprising connection made following Omar’s arrest is his association with a well-known judge.

An analysis of Omar’s communication shows the two have been in communication on several occasions, and have a sexual relationship.

I have not seen it addressed anywhere but did this lady ever handle any Imperial Bank or Mr. Abdulmalek Janmohamed's cases? A scrutiny of all her cases since she became a judge could yield something interesting.

Nope...I think she was probably taking cash on behalf of other Judges...

Sad bit she will get away with it...Very lame excuses as to what the sums were for...

It is the job of the DCI to show commission of an offence. Taking a loan without a formal application is not criminal.

Having your son hired by Imperial Bank0 is not an offence nor does it raise any inference that one has been committed.

Public officers are governed by the Public Officers and Ethics Act. The primary ombudsman is the EACC where the DCI comes in mimi sielewi.

Breach of Ethics does not prima facie showw the commission of an offence, ethics at most is dealt by adherence to one's religious code in our context for that mattter crime is weighed by the penal code.

She will get away with it but damage has been done...

How does she use a formal letterhead to get a personal loan?

Quote:
The Directorate of Public Prosecution now says in an affidavit filed in court that “the circumstances under which (Justice Mwilu) received the Sh12 million were clearly illegal” and (that she) “obtained financial advantage of her office” as a state officer “without any letter of offer and with Nil interest.”
