that was the most probable outcome, however she is not guilty, just suspected.

She is not suspended, not exactly. JSC has resolved to "send a petition to the president asking him to suspend the DCJ". What Kibaki will do is anybody's guess.

History made in Kenya. A kawaida watchman with no connections effectively sacks the deputy chief justice.

Remarkable how double edged such an incident is:

-It has killed Baraza's professional career
-It has raised Mutunga's public profile in equal measure. Unless he does something stupid between now and elections, we can rest easy that we have a CJ trusted by the public.

Kibaki's hands are tied. He has to suspend within 14 days and form a tribunal to probe the DCJ. Again, the tribunal's recommendations are binding on Kibaki.
Conventional thinkers waste time building shelters when they are unnecessary and then have no shelters when they need them the most. Socionomists do the opposite.

The charge of behaving badly holds no water, the one of ordering the body guard to shoot is hot air, but the one of possessing an unlicensed firearm is the killer. That is criminal and doesn't require Prezzo to set up a tribunal. My prediction, the prezzo will set it up, it will find no professional miscondunt. DPP has already settled the criminal component of the case by saying Commish did a bad job and asking him to investigate again. Baraza is home and dry, Kerubo is penniless, kenyans are happy that katiba is working but in reality it is life as usual.

JSC by recommending suspension means that in their judgement Baraza alifanya makosa. The makosas could be one of the following or all of them:
1) Kupita soldier bila salamu (Madharau)
2) Kuchuna Kerubo mapua (Assault)
3) Kuambia Kerubo kuwa anatakiwa kujua watu (Madharau 2 / Arrogance)
4) Kuambia Bodyguard apige Kerubo risasi (Hapa iko Chida)

All the above could be due to hasira and could be excusable. This is where the real beef is:

5) Walking away and then COMING BACK with a gun. (Illegal possession of firearm. Premeditation. By the time she is walking away, asking the driver for a gun and then walking back with it. Hiyo sasa sio hasira. This is deliberate intent to cause harm. Kwa sheria inaitwa "Mens Rea" or "Criminal mind" in English.)

6) Threatening Kerubo with the gun. (In this case this is the "Actus Reus" or guilty conduct. Kerubo had to plead on her knees not to be shot and then she ran away)

I think in all this a tribunal will find her guilty of some kind of misconduct. She is a smart woman. I do not think she will wait for the tribunal. She will resign. She should resign.

Is Njoki Ngungu our next Deputy Chief Justice.

I thought induction is mandatory for fresh recruits into the civil service of Kenya . Were these new faces inducted or they overlooked it and assumed as usual they know it all .

Suspension is very different from a sack !!!! and she'll be back ( maybe holding an ak47 this time . )...the tribunal or whatever will be formed is just to buy time and let public anger cool down ...before you know it she'll be back ..she'll be back kimunya style !!!!! wait and see !
i donot know why people think she'll get the sack ...maybe just a fine on top of the suspension .
To loose such a high profile job becasue of a small incident the village market ...common lets be realistic
