The story, “Kenya’s Secret plot against the ICC”, falsely accuses the Head of the Civil Service, Mr Francis Muthaura, one of the suspects of the International Criminal Court popularly known as the Ocampo Six, of heading a “think tank” to subvert the ICC process and execute a secret plan to pull Kenya out of the Rome Statute that established the ICC.

The Commission established that the story was a fabrication and the said think tank did not exist and that the investigation of the story fell below expected professional standards. Furthermore, the Commission agreed with Mr Muthaura that the story was calculated to prejudice his standing before the ICC and injure his reputation as a career diplomat and Head of the Kenya Civil Service.

The Commission also ordered each of the two authors of the story – Ben Agina and Beuttah Omanga –to write a personal apology to Mr Muthaura.

In addition, MCK ordered the Standard to remove from its online archives the story, which was published on January 11, 2011 as the lead story, and to write a personal apology to Muthaura.

Speaking while delivering the ruling, Commissioner Murej Mak'Ochieng told the standard to pay the fine within 14 days to MCK, failure to which the matter will be forwarded to the commission. The two accused reporters were ordered to pay Sh50,000 for publishing the article and Sh200,000 for failing the ethics test or face three months and six months in prison respectively. They should be made to apologize on the same page the story appeared. It should appear as the headline for the same day the article appeared ie, We will Always apologize for Misinforming the Nation.
