What that boy said is filthy and uncalled for but to jail him is going a little too far..... no actually to even arrest him is to set foot on a path that leads to a very slippery slope. Freedom of speech is a precious thing, it is what allows us all to speak our minds to say deep things like @tycho to tell it like it is like @alma, to defend and explain our faith like @alphadoti, to teach, to rebuke to encourage to let our agreements and disagreements be heard.
In this same space you are going to have truants and misfits and they too will speak; in ways we do not fancy and say things we do not like. I say the right response is for those who feel offended to use their freedom of speech to disagree with them but for heavens sake let not the state come in to limit this freedom.

If I was an Uhuru adviser I would advise him to offer the boy presidential pardon mara moja. He kills 2 birds with one stone, he kills this debate and at the same time scores a few political points.

If I was an Uhuru adviser I would advise him to offer the boy presidential pardon mara moja. He kills 2 birds with one stone, he kills this debate and at the same time scores a few political points. To the contrary, am not sure if you read where he called for the killing of the president, the forceful removal of an ethnic community and yeah the petty insults. I support the jail term and I also support the charges against others like him "keyboard warriors" to whom freedom of speech is not exercised with responsibility. Alai, Mugo and Kuria should all face the same fate regardless of their political standing. Freedom of expression should always be tampered with responsibility towards others. Kenyans must mature quickly to understand that whatever happened in 2007 did not die with the formation of a coalition government, it was just but a hasty retreat, a band aid. If you remember correctly, it is what lead to the creation of the national cohesion laws. Why would we be so quick to forget the cyber battles that incensed the web which in turn polarized the entire country? Freedom of speech to an immature individual is akin to giving a loaded gun to a toddler. About setting him free that would be Moi-esque for Uhuru to pardon him for political mileage. Kratos you need to understand that since the beginning of man, all over the world, there has never been anyone who was sucking up to the big man who has ever been jailed for uttering despicable things. Mugo and Kuria and the boatload of Facebook so called bloggers utter some very disturbing things. But they will never be jailed. Laws on Freedom of expression, have been entirely used to jail and cower anyone who's not with the political class. That's why we said that these are guaranteed in our new constitution. Yaani, how many times did Kibaki call his own citizens "mafi ya kuku"? Did anyone jail him? When Duale tells Ruto that "pesa sio ya mamayake", does it mean that he has the right to abuse a public official? This case will be used by historians to judge Uhuru I really do miss Kibaki...As in seriously when did you see him bother himself with silly bloggers. Jose: If I make it through this thug life, I'll see you one day. The Lord is the only way to stop the hurt.

Alma, lets separate the insults from the war mongering posted by the young man. As any student on physiology will tell you, repetition of certain deluded opinions such as removal of ethnic groups is what I and any well meaning Kenyan is and should be against. We have to admit that there are the fickle among us in society who will easily be brainwashed to believe that such ideas are logical and for this reason i stand against such "freedoms". While it is indeed true that in the past we have had regimes hell bent on suppressing freedom of speech, that should not allow us to fall into the trap of careless utterances leading to ethnic divisions. Can anyone share details on what his actual conviction ? Not the charges but the final ruling.

What kind of legal representation did Wadi have? Does the other boy have representation?
I suspect that none of them has counsel. And so the courts are likely to be unexercised. And justice becomes fuzzy.
For example, what would cause Wadi to plead guilty? And even ask for mercy- if at all @Lolest is correct? Confusion? Is it true that his citizenship was(is) in doubt?
