A quality argument you present, though a bit too textbook (and reeking of intellect rather than intelligence and perhaps coming from the legal fraternity whose bounds of logic are determined by the written law or the spirit of the law)....but, if the private company has as its shareholders, people in government/civil servants/people with vested interests ...using that shareholding as a way to get their kickbacks?

Why all the mystery anyway - if its above the board its effing above the board - so why all the the secrecy?

@Jaguar - thanks for that link. I;d like to especially focus on a keyword in one of my earlier posts - interconnection and then quote the article :


"The interconnection charge makes calls to a different network more expensive than calls within the same network"

Perhaps @Monzenrat can review this vis a vis 80% of the traffic terminating in ONE network and the remaining networks having to bend over backwards to get decent interconnection rates from THAT network...and then gauge their ability (or inability) to participate in a pricing war...

@djinn, the new regulatons is a government "project". The only part i don't agree with in the new regulations is the 90day waiting period if a dominant player wants to review their charges downwards. This duration should be reduced to 30days in my opinion.

You really don't like facts, do you? But the thing about them is that they are very stubborn.

For your information, ALL player pay a STANDARD RATE of 4.27 as interconnect charges for cross network calls as DICTATED BY CCK. That means that Safcom has NO control as to how much calls from other networks that terminate on its own are charged and that you can forget paying anything less than 5 bob for cross network calls on any network. Here I'm quoting Mr. Menza of Zain.

If your are talking about Safaricom's tariffs for calls FROM its network to OTHER networks, that shouldn't concern you if you DO NOT (as you emphasized so vigorously) use the Safcom SIM card. And anyway, how would the reduction of those tariffs help the small potatoes? It would probably be branded "anti-competitive" as it would encourage Safcom subscribers to stay.

Kickbacks? you have proof?

Why the secrecy? That's why its called a private company. If you and your wife and kids form a company that buys shares in Safcom, whose business is that, except yours?

How would you like it if you were forced to disclose your own business strategies to your competitors thirty days before you implement them? This is killing competition and innovation not protecting it.
Even the Rabbit farmers on this very forum (was it @Njunge?) refused to disclose their markets.

Hmmmn, even the government agrees that the clause needs to specify 'abuse of dominance' clearer. And further states act does not imply anyone has been abusing dominance thus far...

On another note, bullying Safaricom seems to be eliciting some public sympathy against the previous apathy towards the largest provider.

Of course I stand to lose. I'm a shareholder and my company's management are doing their utmost to improve my ROI...

Then some busybody on Waiyaki way decides to crush its innovation by forcing the company to disclose to the small potatoes for them to copy and launch at the same time that Safcom does.

You can imagine - the next MPesa-like product that Safcom comes up with.. they disclose, the others copy and they all launch at the same time... How will my dividends ever increase?

I think Safcom should take this to court.

how do you disclose your business strategies to a regulator? How secure will those plans be? No wonder the other operators are for the iadea since they don't hold dominant position. They want the business secrets of Safcom revealed to them 30 days before implementation. This is sure to kill innovation.

wonder how comes `the standard` has not connected the CCK war to Michael`s retirement..damn gossipers.

safaricom must make profits, whatever we pay for calls and data connection is what safaricom needs to make PROFITS..not a KILL. what the potatoes were hoping for was a kill and one went further to buying an empty Box. if they want to survive, let them increase their tariffs..if they dont know how..damn it..close shop..fungua chips na matumbo take away joints....or lease their license to apple bees.

Zain has reduced its crossnetwork tariffs to 6bob and 3bob for intra-network calls. Now thats the way to compete... As a customer I'm really tempted...

Now you tell me, is this fair competition? If Safaricom wanted to react to this by reducing their call rates, they would have to wait for 90 days. But if it was the reverse, Zain would react by reducing theirs the next day - if not the same day!!! Is this fair? And how is the consumer/subscriber benefiting? You stop safcom from reducing theirs tomorrow if they wanted and you tell me you are protecting me as a subscriber? Seriously! This is a lorry load of horse manure!!

And the guys supporting CCK, do you really need a degree in telecommunications or business to understand the effect of this to business/investment?

@ Everyone - Did you read the article on the CCK regulations on today's standard - Editorial? If you didn't, click on the link below.

These guys need to acknowledge Wazua as the source of their information. That was purely a copy-paste job from this thread. No wonder they keep misinforming Kenyans - who knows which other sites they get their information from. They are lucky in wazua they can get a pretty balanced and informed analysis of issues.

My friend, Mix is a foreign product. Safcon had nothing to do with developing it. This is like the "innovation" about FB on Safcon. Just making news. Nothing much.
