“The failure by the 1st Respondent to verify the results in consultation with the 2nd Respondent, before the latter declared them, therefore went against the expectation of Article 138 (3) (c) of the Constitution…we find little or nothing in this decision [Maina Kiai] to suggest that, by deciding the way it did, the appellate court restrained or barred the 1st Respondent from verifying the results before declaring them,” the Supreme Court had said in its 4-2 majority judgment.




Very precise prayer but 'veiled' goggles hinder understanding.

But in real sense it is the legislature who've put us in this mess...by doing half baked job with elections act...how errors at various stages of the electoral cycle are handled prior to final announcement of results should be the subject of comprehensive regulations and legislation. When you do half baked job and leave it to the courts to make determinations, be ready to live with the consequences

It is the same power hungry group of evil forces that arranged for our young African leaders, Uhuru and Ruto to be sacrificed at ICC still haunting us, meanwhile their leaders are left to kill poor farmer's and their families with wanton destruction of the environment, hoodwinking the poor using poor and stuffing billions into their families account's, now 23billion has already started being spent, we are therefore forced to go ahead and pour the whole amount down the drain as a third world "experiment" through some NGO's, and the judge says he can make us do it all again, full of nugu shenzi type nyeez and lust for power at whatever cost.

If Judiciary is refusing to cooperate, why don't the EACC, the police and the DCI just storm there and get what they want. They have done it elsewhere. Or are judiciary staff immune to the law?
