One of the things that will finish this country is "Uwoga" or indecisiveness. In my opinion this is worse than tyranny. A leader must be firm and decisive. The reason why you have a title CEO or Chairman is so that the buck has a place to stop. Make a decision and go with it. You might be wrong in which case let someone else go to court to stop you but you must have strength of conviction to act and act decisively. Appointing weak and indecisive characters to leadership positions is a recipe for disaster.

I have not always been a fan of Ruto but he has won me over on this one thing. This is the one guy who to me has shown true mettle of a leader. Another one was Michuki.

He was decisive then the court blamed him for nullifying the elections. So the courts need to be clear, the Maina Kiai case concluded that the results at the polling station are final. So he announced the results based on that. Now the SCORK in its detailed ruling said he violated the that same law and insisted that he should verify. So should he go back and tally all the forms 34A&Bs?

The court made a ruling. Elections were nullified and IEBC must repeat them. IEBC must repeat the elections according to how they know how to conduct them. By this action IEBC is relegating its authority to the court. The Supreme Court is not the electoral agency. If you get a yellow card in a game you do not go consult the ref on how to play football. Just because a ref can give a yellow card does not make him coach. You continue playing.

If the Ref says that the offside rule does not apply you will have to seek clarification and guide your team accordingly.

I think it is the right thing to do...for one i believe the ruling in maina kiai case was too pedestrian when you consider the reality. My view is that if the national RO discovers inconsistency between Form 34As and B for particular constituency, he should send back to the constituency RO for correction. And the RO invites agents and interested parties to sign the corrected forms. That'a why you have 7 days to declare the result. For any court to rule that even if the national RO discovers errors in form 34Bs during verification he cannot change anything and he has to declare the wrong result and thereafter wait for court of law to change the same, that the national RO is just a mere conduit, is to make nonsense of civilization

Are you not seeing that the ruling was not clear and needs to be verified?

There is a big difference between wisdom and just being indecisive. Being firm and bold in action does not mean that you do not seek counsel but you cannot allow a sense of anarchy descend on an organization by being weak. Weak leaders can also be very ruthless when they act out of fear.

Chebukati reminds me of President Charles Logan in the series 24. Gregory Itzin's performance in portraying President Logan is one of the greatest performances ever in the history of TV or Film. He is phenomenal in his portrayal of a leader who cannot make a decision that results in disastrous consequences.

The electoral agency Chairman Wafula Chebukati has gone back to the Supreme Court to seek clarification on his role as regards to verification of results declaration forms.

He argued that while the Court of Appeal had in the Maina Kiai case ruled that what is announced at the polling station is final, the Supreme Court in its landmark ruling that invalidated the August 8 poll indicted him for not verifying the crucial documents.

“Arising from the judgment of this Honourable Court, I am now unclear as to what as the returning officer for the presidential election I am supposed to do in view of the clear prohibition at page 39 of the judgment of the Court of Appeal in the Maina Kiai case barring me from “varying, confirming, altering, modifying or adjusting the results,” Mr Chebukati says in an affidavit filed at the Supreme Court on Thursday.

The Independent Electoral and Boundaries Commission (IEBC) argues that the apex court should ‘complete the lacuna in its direction” that it says will be critical ahead of the fresh poll scheduled for October 26.

“The failure by the 1st Respondent to verify the results in consultation with the 2nd Respondent, before the latter declared them, therefore went against the expectation of Article 138 (3) (c) of the Constitution…we find little or nothing in this decision [Maina Kiai] to suggest that, by deciding the way it did, the appellate court restrained or barred the 1st Respondent from verifying the results before declaring them,” the Supreme Court had said in its 4-2 majority judgment.
