I think valid presidential votes cast in the wrong boxes have now been included in the tallying

the rejected votes have drastically reduced at thisvrate hazitafika hata 50k...compare that to the previous figure.

Are you sure about this? Has it been officially confirmed?

about the reduction I am sure...about the 50k should have said a higher figure lets say that 174000 figure given above...

So far they form 0.72%.....circa 72K votes in total!!!

Section 77(1) of ELECTION REGULATIONS states that rejected ballots shall be "..void and shall not be counted". What law is applying?

The Elections Act,the regulations thereof and all subsidiary legislation cannot supersede the constitution. That is simple legal parlance...
Art 138(4) is clear on the tallying process it reads "A candidate shall be declared elected as President if the candidate receives
(a) more than half of ALL the votes cast in the election. Its an issue of statutory interpretation but its actually very simple...

I thought SUBSIDIARY LAW is always DERIVED from the SUPREME LAW??? Therefore, subsidiary law further elaborates the supreme law, or so I thought!

There is a difference between ballots and votes! Rejected ballots are not "votes cast"

Whaaat!! if this is true, then this election is a wrap.. I don't know of any democracy anywhere where rejected votes are added to the total tally..I thought our constitution was borrowed from the very best in the world..this is serious stress..

...ngoja interpretation ya supreme court@simo,subsidiary law is an auxillary aiding or a supplementary portion of a particular law.The simple position is this:-In the event of any doubt in interpretation or conflict thereof the supreme law subsists. It is wrong to even imagine that subsidiary legislation to the Elections Act can supersede the parent act.
