One of the principles of international law is that a treaty does not create either obligations or rights for third states (pacta tertiis nec nocent nec prosunt) without their consent, and this is also enshrined in the 1969 Vienna Convention on the Law of Treaties

I mean rao the other day was talking of having the cases brought back, so was mdvd, what was the basis? It was here on wazua http://www.wazua.co.ke/forum.aspx?g=posts&t=22264
and all over the press, then you go further and say a President of Kenya will be working from ICC? Is it only Raila who can bring this guys back when you see things through cord lenses?

IMO, such a situation will be handled politically. The party with the majority in both Houses will decide whether the two will govern us from the Hague or not.

Yes, Article 145 provides for impeachment of the president. And yes, it is a political pocess.

Two thirds of support from both the National Assembly and the senate is all you need!

In such a situation, there would be no sanctions.

But then you have to quit Utopia pronto, for that is not practical!

Once you appear before a Court you are subject to the schedule of the Court and not your Business/Political/family, etc conveniences.

The Court can even find that you dont deserve bail and have you put under confinement.

FYI, mine was not utopia but conjecture. For the sake of the points you raise... Supposing the court doesn't even give them a favourable schedule, but they win fairly and cooperate fully.

It seems like you are looking for a way for Uhuruto to have their cake and eat it. Pole can't happen won't happen. It is this simple..... Hague tells them to jump. They jump-No sanctions. They don't jump-Sanctions. Capisce???
