@Simonkabz. You are right. This is what happened.

It would have helped matters if Raila had in the first place admitted that he was consulted but they did not agree.

But the bigger problem is the wording of the constitution. That word "consultation" should never have made it into the constitution. There is no guarantee that two men with ego will agree soon. They may even decide to maintain their positions and never agree. What will be the way out? Even what your are calling the "spirit" will not help matters.Marende is in a very tricky position.

But this is the truth" If that list had one Kikuyu and one Luo" There would have been consultations. Very unfortunate.

@Petro
If the 2 principles do not elect a new CJ by the 27th of February, then their terms end and we go to the debe. the constitution is clear on that. How clear do want it to be. They must consult and consult properly

I blame the impasse on mjuaji Nzamba and his team of arrogant know-it-all 'experts'.

When people tried to point out such issues during the constitution review process they sneered at them.

Why would you blame the constitution drafters, they took into account the fact that there were 2 principles and made the constitution to force them to work together. Had Baks had the go ahead to name without consulting, we would be having Kihara, Githu,,,,,,,

They left a lot of unclear areas in there.JSC is shouting they should be the ones in charge.The CoE also imported from an Act with flaws and hence the curret crisis.

I'm waiting for a bigger crisis next year when Marende and the 222 brigade refuse to vacate office!

Back to the drawing board. Process begins afresh. Speaker rejects the list and subsequently stops parliament from proceeding with approval of the nominations list.
