Though Wambui is not a wazuan, she said the most regrettable thing about TNA, the First Family, fellow candidates,

JANUARY 2013: The Independent Electoral and
Boundaries Commission (IEBC) is concerned that disputes arising from
political party primaries are causing confusion among the contestants and
the electorates. The Commission is particularly disturbed by the manner in
which some members of The National Alliance party (TNA), led by the
outgoing MPs — Ms Rachel Shebesh, Cecily Mbarire and Njoroge Baiya
stormed IEBC Headquarters demanding that the Commission assures them
that their candidate, Ms Mary Wambui, has been nominated for the Othaya
parliamentary seat.
The nature and gravity of their grievances notwithstanding, their behavior
and method of addressing these grievances is unacceptable and unlawful.
Further, their action was a breach of Regulation (6k) of the Electoral Code
of Conduct which requires that political parties and candidates
acknowledge the authority of the Commission in the conduct of elections
and to take all reasonable steps to ensure the safety of the staff of the
Commission.
We wish to state that the Commission is not directly involved with
nominations by political parties and is not responsible for the outcome
neither can we alter the names of nominees as presented by a Political
Party. The Commission expects all disputes arising from the political party
primaries to be first resolved through the Political Parties internal disputes
resolution mechanisms as provided for in their respective party nomination
rules and constitutions.
In pursuance of Article 88 (4) , (e) of the Constitution and for purposes of
Section74 (2) of the Elections Act, the Independent Electoral and
Boundaries Commission has established a Commission Dispute Resolution
Committee comprising of five (5) members appointed from the
Commission to adjudicate and determine all disputes lodged by
complainants to the Commission.
This team will be in session at Milimani Law Courts, Ground Floor, Court
No.1 from 9am to 5pm upto Friday 25

, January 2013. We urge for
patience to allow this committee to discharge their mandate.
In addition, the names of candidates nominated by the political parties are
currently being published on the Commission’s website and will be availed
to the media. These are the names submitted by the political parties as at

January, 2013.
We wish to state that this Commission will take stern disciplinary action
against any aspirant (s) who breaches the Electoral code of conduct. The
Commission calls upon all aspirants to show restraint and maturity in the
way they address grievances concerning elections. We do not contest
elections as IEBC. We will continue to provide an enabling environment for
free, fair and peaceful elections.
In conclusion, and for the avoidance of any doubt whatsoever, this
Commission shall take any and all measures placed at its disposal in the
Law to ensure a disciplined and orderly electoral process. We shall enforce
this to all irrespective of their standing or stature.
