I thought PORK has power of mercy. This guy has suffered enough to have already paid 'in kind' for his mis-steps. Considering also he helped them indirectly in 13' (when he was enemy of their enemy), they should just release him. No need to fight a mosquito with sledge hammer.

3.In the morning, Kenya asked the Canadian High Commission to offer their Citizen consular services at the Airport. Kenya even asked Canada to personally handle the passport for Miguna, as an assurance that Gvt was not interested in holding his passport

4. Canadian officials spent Three hours with Miguna at the Airport and he declined their assistance.

5. Government was still willing to facilitate Miguna's entry and after Canadian was unable to convince their citizen, Government through Immigration printed forms for him to fill so as to apply for a Kenyan passport or at least temporary entry documents.

6. Miguna shredded the forms provided by @ImmigrationDept, by tearing them up.

7. Meanwhile, his legal team was shopping for a friendly Judge and they got one. Justice Roselyn Aburili - they also got the orders they wanted.

Is this learned friend aware that nationality and citizenship are not the same thing.
While the former is inalienable, the latter is conferred to by the state on application.

The law will be followed to the letter. Miguna will be released from police confinement and allowed to go and process his immigration issues. After he is allowed into Kenya he will be produced in court tmr, or he can choose to take himself to court. The law is the law and it must be followed by all, and laws do not work in isolation of other laws and therefore the court order doesn't in any way emasculate the immigration laws.

a waste of taxpayers money.... a waste now by giving such kind of work the attention of government workers as well a waste later in years to come when Miguna Miguna will successfully sue the Executive for damages... it's a Pyrrhic and short sighted victory

The Immigration department is under the rule of law of Kenyan courts. The order you wish us not to read includes the Interior Ministry and the Director of Immigration.

The court order, the third one, clearly includes the immigration department.

It's the duty of the govt to enforce immigration laws. The world also required Kenya to enforce IATA/ICAO laws and regulations regarding immigration and movement of persons across international borders. Infact Kenya has scored quite highly in following and enforcing immigration laws and procedures. The whole world would have been shocked if the Kenya govt would have allowed a traveler into the country when he didn't have proper travel documents.

Bwahahaha. Govt now saying they can't enforce the court order to produce miguna in court tmr because they don't have a person my the name Joshua Miguna Miguna in their custody. They say they only have an undocumented male who arrived on an emirates flight and has no travel documents and therefore don't know who he is. You do know that an ID is not the only way to identify an undocumented person? The same officials were this morning tweeting that the same individual was called Miguna Miguna and they were sending papers for him to sign.

Hardwood, kwa kweli. You are losing support even from people who don't like Miguna. Very quickly.

Do the needful. Take him to court, prove he's not a citizen then deport him. It's that easy.

Really shameful for Kenyans at large.

@Hardwood aaaaaaaaiiiiii!! This Kenya that has Al Shabab walking in and out like it is their manyatta. If you go to Namanga and stay at the hotel on the Kenyan side you can walk to some food joints on the Tanzanian side because they have better meat. If you are in a bus headed to Tanzania and approach the border you will notice a few watu wa biashara who will ask the driver to allow them to alight a few hundred metres before they reach the border because they do not want to deal with immigration people. They cross on foot and enter the bus when the bus gets to the other side. In short what I am saying is that Kenya's borders are porous and we are not famous in the world for enforcement of immigration laws. Go to Gikomba and find out how many Tanzanian mitumba salesmen have proper travel documents.

This is all about Matiang'i's ego and in Miguna he has met his match. Kichwa Ngumu vs Kichwa Ngumu and in this one Matiang'i does not look good at all. He has been ill advised and if someone knows him tell him that it is time to retreat. Imagine if Uhuru had the same mentality that Matiang'i has when August 8 was nullified. He could have lost all legitimacy. It is not too late to release Miguna and admit defeat. Miguna has so many things he needs to do like look for fundis to fix his doors and windows. Kenyans also have a short memory and will soon be tired of listening to Miguna because sooner or later he will be insulting them.

How are authorities expected to identify an undocumented traveler who lands in their airport from dubai and has no travel documents. That is why he was being deported to where he came from. He can only be released when he identifies himself by producing a valid travel document.
