In their judgement, the judges faulted IEBC for failing to consult all candidates in the August poll before awarding the Sh2.5-billion tender to Al Ghurair.

is that the law of the land? Do we really expect the candidates to agree? Mbona others are credible na hii presidential is not? is Al Ghurair the real problem here? IEBC should repeal this decision, move to Court of Appeal.

I dont support but there something stupid in the constitution about public participation

What's the way out of this quagmire?

Scenarios........ presidential vote is delayed as others start earlier....legal implications?
2. Direct procurement sabotage so tendering is overtaken by election date....constitutional crisis ensues and nusu mkate pap.

Way out for Chebukati? Seems he's conered together with the entire election. Is there a way out?

If IEBC appeal the case will drag past 8th August.

By the way, suppose the IEBC throw in the towel and resign en masse?

Public participation is just nonsense by the court to continue causing confusion around this elections. How will the public participate in the remaining four weeks. How do you measure public participation? Isn't this not enough for another clown to move to court once again citing the same issue? This is tiring!Eh?

The effect of this judgement seems far reaching but IEBC can render it academic -
move through the motions of public participation then appoint by direct procurement, latest July 16th the same company - al Gurair to finish the job.

Taxpayers to pay the company Ksh 5B for cancelling the contract. Baba should be made to foot this bill coz it is as a result of his odjinga.

Also if the company is competent to print all the other ballots for MCA mpaka governor what is so special about presidential ballots? It's either the whole tender was flawed or not. You can't cancel printing of some ballots and not others. Baba has become a big nuisance to the country. The judges also appear unlearned and lacking in wisdom and even common sense.

At the Court of appeal IEBC is likely to have their way given the circumstances we find ourselves in as a Country not least the limited time there is to 882017.
Separately, I understand the contract between IEBC and Al Ghurair is one that covers all ballots for all elective posts.
For IEBC to now approach them to change some aspects of the contract at this stage when part of the printing is underway is problematic.

The Company could easily demand that the contract is honoured wholly at least in terms of payment, or discontinued wholly.
Once again the Kenyan taxpayer losing money unnecessarily.
