Me thinks that Ruto will be the de facto leader in the later stages of the second term. This would place him in unassailable position come 2022!

In Nairobi, Gem MP Jakoyo Midiwo, who is opposition whip in the National Assembly said the President’s decision to appoint an acting president amounted to absconding duty.

By walking out of his office on Monday a civilian after signing a Gazette notice appointing Mr Ruto Acting President, Mr Kenyatta had resigned, he said.

“The President literally resigned. He misunderstood Article 147 which he quoted and signed his way out of power.”

However, former Attorney-General Amos Wako said there was nothing unique in President Kenyatta’s decision to temporarily hand over power to his deputy.

By appointing Ruto acting president , there is a constitutional breach in the spirit of the law. The President is saying he can choose whoever he wants to hand over power to. Secondly, the law does not provide for how Ruto hands over power back to him. And three the office of the presidency is complete with both the President and Deputy President position constitutionally filled .

In this regard, the Supreme Court should provide interpretation of Constitution on presidency to avoid lacuna and abuse of power.

Lawyer Kiprono Matagei has moved to court to compel Chief Justice Willy Mutunga to swear in William Ruto as President for the remaining three years of the term of Jubilee coalition

That name betrays it all, I have nothing else to say. Absolutely, I have nothing to say

That dude is joking, really joking......he doesn't know the risk he is getting into!!!

I beg to differ McDoba. I actually think that this is a healthy thing. The president has done something unprecedented. What Matagei will achieve by going to court is clarity about this kind of decision. I think anybody who seeks resolution of a constitutional or legal problem through the court process helps strengthen our institutions and deepen our democracy. It is in the same spirit that many years from now when all political temperatures have cooled down that historians will recognize Raila's contribution in clarifying and strengthening the electoral process by challenging the 2013 election results in a court of law.

I say let Matagei have his day in court. Let him be heard. We will all be better off for it.
