Because the 'presidential election' as per Raila 2013 ruling does not require fresh nominations, so how would '3 days after nomination' come in? Hence, in my opinion, we may probably have an opportunity to see: 1. Another Court melodrama 2. Uhuru appealing to same court he insulted 3. Njoki Ndung'u probably having to go against the 'Raila 2013' she so loved 4. Maraga's court learning the wisdom between 'the greater Good' and 'God is in the detail'

What if 8 of you were running for MCA and your opponent who becomes No 2 goes to court to petition your win and the court says kirudiwo. Then your opponent chickens out 2 weeks to the rematch. What would IEBC do? Common sense dictates that IEBC should declare you elected unopposed and you should be sworn in ASAP. Therefore Ohuru should be sworn in ASAP. There is no legal lacuna.

Like the last time, I'll seat here and watch the wazua lawyers bash him. Instead of looking for a way to go around this. There has to be a way, but Ahmednassir has already started giving legal advise on twirra. Advise he failed miserably to articulate when it was important. That Njoki Ndungu ruling is the crux of the matter. Popcorn please. Thieves are not good people. Tumeelewana?

If not, then IEBC will declare UK president. After that baba might decide to go to court or just retire more 'honorably' if he goes to court, The Court will tell them it was ready to annul the repeat elections if IEBC repeated the same mistakes as it did on 8/8, they will then be asked why they withdrew yet the court is open? i.am.back!!!!

I don’t hold brief for IEBC but if I did, my response to NASA would be as follows: • The purported withdrawal is time barred and, actually, invalid. Candidates are only allowed to withdraw at most within three days of the nomination. This is in public interest, to avoid the country incurring heavy costs. Even then, the withdrawal contemplated in the current applicable law is where a candidate does not wish to participate any more. IEBC is of the understanding that NASA is still interested to participate in the election, only that they are requesting a postponement. • The supreme court ordered there must be a fresh election within 60 days • The issue of who participates in the fresh election is still in court • IEBC has no legal mandate in law to cancel the election and order another one in 3 months as demanded by NASA • The grounds cited by NASA have been addressed. The court has also ruled that IEBC, as currently constituted, is able to conduct fair election. By the fore going, IEBC having gone through the request, do not find any reasonable basis to postpone the election as requested. The election planned for 26th will go on as planned, in accordance with SC’s orders. For the avoidance of doubt, IEBC will make an application at the court to affirm this position.
