If Nakumatt contracts you to supply their stores with sukuma wiki, and then issues arise regarding payments, then it is the Nakumatt finance officer who should answer any audit questions or kufungwa, not the supplier.

317. Conspiracy to defraud
Any person who conspires with another by deceit or any fraudulent means to affect the market price of anything publicly sold, or to defraud the public or any person, whether a particular person or not, or to extort any property from any person, is guilty of a misdemeanour and is liable to imprisonment for three years.

Quote:
CHAPTER V – PARTIES TO OFFENCES
20. Principal offenders
(1) When an offence is committed, each of the following persons is deemed to have taken part in committing the offence and to be guilty of the offence, and may be charged with actually committing it, that is to say—

(a) every person who actually does the act or makes the omission which constitutes the offence;
(b) every person who does or omits to do any act for the purpose of enabling or aiding another person to commit the offence;
(c) every person who aids or abets another person in committing the offence;
(d) any person who counsels or procures any other person to commit the offence

So you must draw a dotted line between the person who gave the tender and the one who was given. So the only person who will rat out Kabura is the guy who signed the LPO!

She doesnt want to state who that is. She keeps claiming that she was called by the procurement department. The woman doesnt even know how to read the statements clearly she was not in this alone. But she is the signatory of the bank accounts

What the Kethi Kilonzo drama showed me was... it's dangerous to have responsibility. there was a guy called Lemiso who kept the key for the safe where the voter slips were kept as soon as it disappeared and appeared on Kethi's hands... the guy who has the custody of the slips is put on the dock. So there is an LPO somewhere or a wire trail going back to a guy who has 'custody' <-- that's the guy to apply pressure on. Kama mimi Kabura siwezi sema chochote! why jikaanga? it's not in her interest to rat herself out.

She said that non of her 20 companies had any pre-qualification infact she doesnt understand what that is

Even if she wasn't in the database, is that her problem? If a client walked to your office with a list of items they want supplied, would you refuse and demand pre-qualification and tenders?

Also you mean an IT expert (yes she said that she previously worked for Kenya Data Networks as an IT expert - maybe she is a programmer) who had been supplying govt even before waiguru was appointed CS doesn't understand supply manenos and cant even read?

Kabura, clearly was being used by the procurement guys at the ministry, if you listen to the proceedings when they were reading the inflows and outflows of cash from her 1 account roof and all trading the trail was .... deposit 30M 11 march - withdrawal 1m 2m 10m in cash different days or different time. Mind you, she is the only employee in these 20 companies. Take a listen

Did you see the part where the lady came to help her locate something in the documents she was looking at and had to turn the book/file around. It looked like it had been upside down.

And why were these people talking over each other and asking multiple questions at the same time? No wonder she was answering what she wanted to answer. They should have divided all the info they had into sections, assigned responsibility of each to one individual, they had that person ask one question at at time until that section was done then move to the next one. They just looked unprofessional.

Kwanza the most annoying part was that woman who came in late and started asking questions that had been asked and settled earlier. And the others who were asking leading questions...very useless.

Kabuki was very well advised and her sponsor must have hired the lawyer who sat next to her for their own interest. The only area anyone can find fault in Kabura is tax remittance/declarations and maybe money laundering which is almost impossible to prove in our well rigged court system, otherwise she has no case to answer.

BBI will solve it

That's how to answer a clueless committee. Kabura was just a conduit just like Kago, the millionaire driver.

This just goes to show that the system has failed, as much as I believe we Kenyans are easily corrupted by those around us, alot of the corruption and theft that takes place could have been easily avoided if their was a willingness on the part of the executive to weed out the corruption.
Kabura can go to Langata today but the real masterminds will still be out there skimming there next big heist.
