REJECTED VOTES??!!

This is how people spoilt votes....



Frankly speaking though this is a shame for us to have rejected votes as the 3rd highest votes in the country, it is very damning. If it is a case of the votes in the wrong box but marked correctly then I agree they should count...can you imagine those wold men and women in shagz struggling to tell between beige and white???

As stated elsewhere once a presidential ballot box has been opened, votes counted and resealed, you can't come back and open it later if you get other presidential votes inside other ballot boxes.
Conventional thinkers waste time building shelters when they are unnecessary and then have no shelters when they need them the most. Socionomists do the opposite.

Now hassan says this votes are included in the final tally.
Why not devide the votes according to the final percentage each presidential candidate will get?
This constitution needs an overhawl because this are the same constitutional mess we are having when executing the 1/3 gender rule
Politics is just things to keep the people divided and foolish and put your trust in men and none of them can do nothing for you...

Assume I am a CORD fanatic in a Jubilee stronghold. All I will care about is for the presidency since I know my other votes wont count, so I will pick all ballot papers, 6 of them, vote for my candidate but drop all the ballot papers in the presidential ballot box. That will mean a vote for my preferred presidential candidate and 5 rejected votes. 20 of us means 100 rejected votes and so on. In a race where we want to block our opponent from 1st round win, this method can work. My view is that the constitution need to be amended to reflect 50% +1 of valid votes cast. One word would make a lot of difference and save billions of shillings.

Totally agree. You do not even have to go that far as putting 6 in one which is easy to stop. You just need to have enough of your voters to have your rivals tally rejected.
Imagine how many other stupid idiosyncrasies will be discovered in the new constitution now that all sections will be active. Very poor planning extending into the legal realm. I foresee serious issues in the next couple of months around county vs national functions. Just read Schedule Four and you start getting the idea especially when you combine with some of the clauses in Chapter 5, 11 & 12.

IEBC is being pressured to incorporate the spoilt votes by some.if they succumb, The supreme court must intervene Why? It is unconstitutional to ascribe them to a candidate in computing their percentage,yet omit them in computing their absolute votes

Every time I hear this argument I get confused by lawyers.

Sure the constitution says cast votes.

They forget to say that the same constitution says exactly how the votes are supposed to be dealt with.

ie 1. opend the presidential vote, count, seal it

obviously that by itself says that a rejected vote is not considered to be a cast vote.

I know ODM wants to win this election by any means necessary. But using such things is an example of the folly of electing them.

You don't have to win an election by hook and crook.

There were rules to engagement that were laid down before the election began.

Your own agents agreed that a particular vote was to be rejected. It doesn't matter if that number was 1 or 50 million. A rejected vote is a rejected vote.

I find those trying to use this argument to be insincere to the core.

So I don't see any insincerity here. Rejected votes are included in total tally and no candidate gets any of those spoilt vote. This's as per the constitution.
It just makes you unhappy because candidates' % drop down increasing chance of a run-off!
