So did he say register his protest at the planned sale? Did he resign as a result? The only thing that can make me give him a pass on this is if it turns out that he tipped off the three MPs who went to court over the matter. Or he was somehow working with them discreetly.
It is all too easy for people to blame Moi for the wrongs done during his time while clearly if Moi never had any enablers none of those wrongs would have been committed. In fact he would not have even held onto power in the first place. Time people were held personally accountable for their acts.
