The office of the Director of Public Prosecutions (DPP) has told the court in Nairobi that self-proclaimed NRM General Miguna Miguna was on Tuesday morning charged before Kajiado Court.

According to the charge sheet presented in court, Miguna was charged with being present and consenting to the administration of an oath to commit a capital offense namely treason contrary to Section 59 (a) of the penal code.

“On the 30th day of January 2018, at Uhuru Park in Nairobi County, jointly with others not before court, were present and consented to the administration of an oath to Raila Amollo Odinga purporting to bind the said Raila Amollo Odinga to commit a capital offense of treason.

Miguna’s lawyers led by Senior counsel John Khaminwa and Nelson Havi however insisted that the Inspector General of Police Joseph Boinnet and Director of Criminal Investigations George Kinoti be held in contempt of court for failing to appear before court and failing to produce their client in court.

Treason is NOT bailable. After being charged at Kajiado, he can now be "legally" held in prison as his treason case is heard and determined. Some of these treason cases can take up to 3yrs.
