Elections on 7th???Laughing out loudly Laughing out loudly ......whateversmile . I must say though that some of the arguments therein are stupid and completely pedestrian. Thank God lawyers do not design roads, buildings,crafts and machines otherwise, we would still be in ice-age. Take the argument that the Presidential votes exceeded those of governors sijui MCAs bla bla!. I am of the opinion that the Presidential votes did not exceed those of other seats, rather, it's the number of spoilt votes for other seats which were higher than those for the Presidential votes. This can easily be deduced by the number of vying individuals as follows:

President - 8 candidates
Governors - 210 candidates
Senate - 256 Candidates
Women rep - 299 candidates
MPs - - 1893 candidates
MCAs - 11,857 candidates.

If you introduce the same mistake,error or even the "algorithm", in all the above rows and assuming everybody votes for all the seats, with certainty, the higher the number of contestants, the lower the total number of votes they will get. Never mind nobody is obligated to vote in all the seats......Is there treatment for ignorance?Sad

2. Tallying riddled with major procedural flaws
3. IEBC concerted with cabinet secretaries to influence results

Re: item 4. Do we have any Kenyan law which prohibits hosting election management or tallying system out of the country? I checked the RTS and IEBC website are hosted by Amazon. If there is no law then I see nothing wrong.

23.2 The Petitioners contends that the 1st Respondent included in the final tally the purported results from the ungazetted polling stations thereby materially affecting the result of the Presidential Election.

 

 Ungazetted and undesignated returning and presiding officers

 

23.3 The Petitioners aver that a significant number of Forms 34B were executed by persons not gazetted as Returning Officers and not accredited as such by the 1st Respondent thereby rendering those results invalid.

 

23.4 The Petitioners further aver that all returns without the IEBC’s official stamp not bearing the particulars and signatures of the Returning Officers, not bearing the particulars and signatures of the agents and those not borne on the prescribed forms are invalid.

 

23.5 The 1st Respondent did not comply with Regulation 5 of the Elections (General) Regulations in the appointment of presiding officers; in particular the 1st Respondent did not provide a list of persons proposed for appointment as presiding officers.

 

23.6 Consequently, a significant number of returns were signed by strangers who could not be held to account thereby rendering those results invalid and unconstitutional.
