Grounds of Impeachment again?

Article 145
a) gross violation of the Constitution or any other law. b) where there are serious reasons for believing that the president has committed a crime under national or international law.and c) gross misconduct.

The Kenyan legislators need no grounds for anything.....its all about their self interests and being at the top of the food chain in the corruption gravy train......

The tyranny of numbers gospel is what will rule our politics for sometime.....

URP may be feeling their guy is being boxed into a tight corner by Bensouda.....and TNA are least concerned......time to turn the tables.

Happy Hunting.

If its all about corruption, I wonder who between Uhunye and Ruto has enough resources to oil the deal.

Then afterwards TNA will gang up with Cord and impeach Private Developer. At the end of it the PD who will lose most.

The devil you know or the devil you don't. Impeachment will not be a simple URP+CORD gang-up.

[quote=stocksmaster]What if the impeachment of Uhuru is a URP tactic?

What if they (URP) gang up with CORD to impeach Uhuru? The Constitution does say the Deputy President takes over for the rest of the presidents term.......

With ICC having shown they are not enthusiastic about prosecuting a sitting Kenyan President, wouldn't this be the perfect strategy for Ruto to use the Presidency as a shield against his case?

Why wait for 2022 when you can have the same in 2015?

Desperate times call for desperate measures......

Do you know the process of impeaching the President?

1. A vote must be taken in that National Assembly (NA) with 66.7% support of the impeachment motion.
2. After that the Senate creates a committee to investigate the matter and report to the senate.
3. Senate will vote to impeach or not to impeach the President.

Political risks are too high
Between the 3 steps there are so many risks that the DP would never want to take. If he shows his hand in step 1, he may not succeed in step 2 and 3. E.g. the committee might not recommend any impeachment and that will be the end or the Senate might not support the motion though the NA had voted for the same. also who says an impeachment of the DP cannot be introduced between any of these steps? And what will happen to his case in ICC after taking such such a huge political risk?

Legally it is impossible to accuse the President on the TSC matter
Do you know the courts could also be used to stop the impeachment process at any point within the 3 steps above?

In step 2, the Senate committee would look at the accusation and make a decision. TSC were directed by the courts to pay teachers. It is only the TSC who can be accused of contempt of court and not the President.... And if the President is guilty of anything so is the DP as this is same institution...the presidency. The order was never to the president but to the TSC. How do you accuse the President of contempt of court? In the new constitution TSC is an independent commission.

Who is advising CORD?

I put it to you..... It is very hard to impeach the President in the current setup. CORD should look for something else. KNUT/KUPPET case will lose meaning now as it will be so politicized.
