I'm no apologist for Ruto and I will not start now but on this I 100% agree with him, let's not mix it with the issue of the 500K ghost jobs!!!!

A middle ground should be found.

The Government can quietly negotiate with the Teachers to explore various options.

Issuing a fiat in the way Ruto did is not right. Consider the ramifications going forward!

Who will pay fees anymore!

Again Head Teachers may choose not to allow any students with fees balance to stay in School.

What agony to Parents and loss to Students will that be.

Ruto may then be compelled to issue yet another fiat that no students to be sent home for school fees - then some schools grind to a halt.

Zero sum game!

KNEC Act 2012 10(1)(b)

Functions of the council shall be...

(a)....

(b) Award Certificates or Diploma to candidates in such examinations; Such certificates or diplomas shall not be held from the candidate by any person or institution.

Your question was clear, "Under what law?" Now I need to check on the dunderhead part, whether he is one or not. Either he is a dunderhead, or whoever is calling him so is...Well, I dont think he got a first class, but as law is concerned, he is right. That I doubt is dunderhead.

That may be so, though I think its debatable, but then a responsible person needs to think through the whole process and consider all the possible subsequent scenarios.

Are we likely to end up hurting society more or shall we draw more benefits.

For starters, why doesn't KNEC give out the docs direct to the student upon proper identification!!
