1.If he did etf to Equity King'ong'o prison branch to an account in the name of Maina Njenga then that is evidence though not watertight
2.If Mungiki claimed to have received 30M from uhunye an on the same day bank shows a withdrawal of 30M then again circumstantial evidence.

linking the cash to the violence would be an uphill task. these are the pebbles that Benshuta is trying to turn

Unless one is privy to the details of the case, one can only hazard what this may be all about.

My hunch is that there is already an allegation that he did abc.

What's required now is the hard evidence to augment the allegation.

Cheating on the statement is a possibility, but that will call for cooperation of the Banks involved - a troubling affair.

Might withdrawal from the Rome statute be the best bet here, or are we time-constrained for that move to yield any benefits in this particular incidence!

one fengi might get its hands dirty (you know which one) but the rest ni ngumu

Rich pple know how to hide their wealth. Uhunyes i think the material income comes from Dividends from the company they have invested in companies, which i think is paid to lawyers and then to the accounts which lawyers are directed. Ask your self can you do a search in Kenya for properties using a name? no u need to identify the property then do the search. so what madam are asking in ni kazi ngumu hata kwa githu. for bank account ujue hata ikiwa ni joint huwezi guza, if its in a company name he will have changed directors. I dont think its easy, the requirement is very blanket

You are right Gmg.

You create nominee accounts or shell companies where you appoint proxies to act on your behalf,
the proxies sign over all ownership of the accounts and/or companies over to you,
then you give them instructions on what to do in future with the money.
that's why we have many nominees owning substantial shares in our companies

Then we have trusts, that's another dog all together,

Having borrowed the English law, banks in Kenya are obligated not to divulge customers details,
except where;
disclosure is required under law,
there is a duty to the public to disclose,
where its the interest of the bank to disclose,
where the customer expressly or impliedly consents to disclosure.

All in all ICC has let us down.
we wanted to know the truth.
justice delayed is justice denied both to the victims and the accused.
Their Icc investigations were lame to say the least,
and this issue of money stinks of rent seeking,
political intimidation,
and means of embarrassing the president
the prosecutor lost the case and the judges are protecting her

What you are forgeting is that madam already gave a disclaimer: Its not necessarily a fact that the statements will prove that UK is guilty; he wants them produced "so that to see whether he actually funded the chaos."

May be to calculate their percentage?
What if uhuru claims every kenyan he knows was withdrawing cash from banks at the time due to pev, that might force icc to ask for statemenys from all of us. I am now worried..
I care!

They just want to see UK's money. Can someone confirm that the witnesses who said they wont testify have been ordered to do so?

Confirmed, the two successive decisions will mark a turning point for both cases, mark my words: from cooperation to non cooperation.
