Is there a flip side here? ...me thinks Bensouda is being accomodative cause she needs to time to plug some holes in her case and Uhuruto walked right into that one.

ICC clarifies that only the judges can change date of trial, not the prosecutor.

Bensouda accepts that Muthaura's case can be referred back to Pre Trial Chamber. "....In the particular circumstances of Mr Muthaura’s case, and given that he has elected to waive
his Article 67(1)(c) right to go to trial without undue delay, the Prosecutiondo es not oppose new confirmation proceedings with respect to him, should the Trial Chamber determine that there is a legal basis for such relief."

They were indicted, not by the prosecutor, by the judges. And the judges indicted even after Ocampo's alleged shoddy work. An indictment is quite a serious thing, if there really was nothing to explore here theirs would have gone like the Brig. and Kosgey, who were found not to have a case to answer. Bensouda appears to be more competent than Ocampo. Uhuruto should be wary.
