why kibaki can vie once more

Sad nobody is quoting the law. From the sixth schedule:

Extension of application of provisions of the former constitution
3. (1) Until Parliament passes the Act anticipated in Articles 15 and 18, section 93 of the former Constitution continues to apply.
(2) Sections 30 to 40, 43 to 46 and 48 to 58 of the former Constitution, the provisions of the former Constitution concerning the executive, and the National Accord and Reconciliation Act, 2008 (No.4 of 2008) shall continue to operate until the first general elections held under this Constitution, but the provisions of this Constitution concerning the system of elections, eligibility for election and the electoral process shall apply to that election.


But I remember Kibaki blasting Mwakwere on suggesting a third term earlier this year in a rally in Nyeri.

Mwakwere: Mheshimiwa Rais naomba uniruhusu nianze mswada upewe third term ili kazi nzuri unayofanya iendelee.

Kibaki: Tuliambiwa tutakaa 2 terms. Kwa hivyo mambo ya kusema ati ooh tunakupenda sana Mwai Kibaki, Mwai Kibaki tunakupenda saana...unadanganya nani? Ni 2 terms.

Don't worry, I don't think Kibs is interested in running again anyway. He's done his time and he's happy about it.

Please read the Constitution of Kenya 2010 HERE

We know what it says. In law you can argue that some section of the constitution has contradicted another hence unconstitutional. The above points are very strong.
