"The court publicly indicted 26 people, proceedings against 24 of whom are ongoing. The ICC has issued arrest warrants for 17 individuals and summonses to nine others. Five individuals are in custody and are being tried while eleven individuals remain at large as fugitives (although one is reported to have died). Proceedings against two individuals have finished following the death of one and the dismissal of charges against the other."
Look at Thomas Lubanga's case. He refused to issue the trial chamber with evidence and his case was kicked out. He asked that the guy be kept in custody as he appealed. He promised to give the evidence so the trial chamber agreed to proceed.
The trial chamber is not his to control - remember him being told he is going too far when asking Uhuru how much cash he has?
