CIC Act provides that pending the establishment of the Salaries and Remuneration Commission, the terms and conditions of service for the commissioners are to be determined by the PSC in consultation with the Treasury.....and this was done, who is Muthaura to overule????

It's baffling that Mutua earns such a hefty sum just to recite memos from Muthaura's desk, and yet points an accussing finger at the commissioners.

As someone has said, sheria ifuatwe. A contract cannot supercede a constitution.

From what has been reported in the press, it appears the contention is whether the Commissioners should be in Band A1 or in Band A2. The Deputy Commissioner has stated that they should be in Band A1. As I have stated above, the key question for me is the entry point of the Commissioners in that Band A1.

I agree we have a new constitution but let's not abuse the term, in the issue of CIC pay...it has nothing to do with the constitution unlike the issue of the MPs taxation!!!!!

Exactly!!
The law and policy are two different things. The terms fall within an existing band set out in law (Constitutional offices Remuneration Act 2009 for public servants. The policy being referred to is (by press accounts) a circular sent out by Muthaura. Since when does a circular / policy affect existing law, and existing rights and obligations. Here, the govt has an obligation to honour its end of the deal. (not to try and get out of it by writing a circular).
