Were rejected votes included in the tally?

Yes! And according to the ongoing in court, the IEBC bowed to pressure from CORD and UK Embassy in Kenya to include them against the advice of AG and others.

If Jubilee already got 50%+1 despite them being included, what's the issue? Why bother removing them now?

I think it is to set a precedent for future elections.

Imagine a scenario in future where a candidate gets 49.99% with rejected votes counted, leading to a run of.
However, if the results are based on VALID votes cast, the same candidate may get over 50%.

I think rejected votes should be excluded.

My 2 cents

My opinion is spoilt votes should not be added as they belong to no one.
On other news, was our Governor sworn in? In the function over? Yaani no station covered it because of this case.

BBI will solve it

Interesting how some people have already 'dismissed' the petitions - the 'key' ones haven't even been heard!

Where's admin by the way - many posts here surely amount to 'anticipating the course of a trial or predicting the outcome'. The insinuation that the respected George Oraro is in this for the money is also in bad taste, no?

How about we just wait for the court's decision? It's only a max of 3 days away anyway.

I think so too. This guy is quite respected for the quality of his work. I've worked with him on several occasions and though we do drop quite heavy cheques on his door step, he'll sometimes tell you there is no point of taking legal route on some issues because the case will end up being thrown out and we will just incur unnecessary legal fees.... and that's for a man who is supposedly in this for the money.....

So is he in it to make a name, for history books or because of his political affiliation?
I see nothing wrong with him doing it for the pay. Aren't the ICC lawyers representing our two top suspects proudly doing it for the money? I'm sure the Jubilee lawyers are being paid an arm and a leg.

Probably. If he wins this, it is huge. Any lawyer would love to shine in it, trust me. We were talking about the "pay" being the only driving factor. He sure aint doing it for free, but what i wanted to say is that if it was just the pay, probably, he probably wouldn't scribble his name in it.... He has a name to protect.

The learned lady is pleading with the court to invalidate the whole election based on her evidence. Was the plea to cancel entire election or results of the affected constituency only?
Can you have a hypothetical case where despite giving evidence, the evidence itself is not sufficient to meet the threshold of the actual plea and is therefore thrown out on such ground?

the case made before the court is cherry picked. that is why the court ordered scrutiny of all form 34s and 36s - based on that result we shall know the extent of the 'malpractice'.

so far what has been presented, baring what has been presented in writing is very selective.
plus looking at what was presented the lawyer did not mention (i did not hear) if the final forms signed by the ro and the party agents was tampered with.

announcing on video can be erroneous, like mixing 51 and 15 or reading a 2 instead of a 5 - what is important is that the final form ([0...9][0...9]) signed by the respective officers is ok, everything else is just for the benefit of the ears and eyes

All said and done, what was announced at Bomas after the audit?

@guru the threshold is very low...kethi has already touched on the massaging of form 34s and 36,he wants to prove the principal register was erronerous plus all his using is what IEBC filed...atapitia tu in closing...
