[/quoteam not the only one who shares this view. As we speak, there are proceedings against Prof Mutua in an action instituted by Jeffrey Malkan relating to allegations that Prof Mutua abused his power to Malkan’s detriment.

Makau was Malkan’s dean when the latter was an instructor of a course known as Legal Writing Programme (please ponder the irony, again!). What should have been a straightforward judicial inquiry was hobbled by allegations that Prof Mutua not only perjured himself before State and Federal courts, but also occasioned the destruction of evidence and obstruction of justice. Perjury as a felony relates to deep problems with honesty, or at least a strong affinity to falsehood. Coupled with destruction of evidence, the allegations suggest a level of impunity that can harm institutions and destroy individuals. It could transform him from Distinguished Professor to Extinguished Professor at the stroke of a pen.

Make no mistake, Uhuru case at ICC is not political football

Quote:
But Ms Bensouda is also saying something else – that the Government of Kenya is obstructing justice by concealing, or refusing to produce, necessary evidence. Obstruction, if true, is a serious offence, and could come back to bite Kenya in the rear. Legal processes can’t just be wished away through obstruction.

Quote:
Which brings me back to the Kenyatta-Bensouda chess match. Folks should calm down and stop reading too much into ebbs and flows of Mr Kenyatta’s case. The ICC has ordered Kenya to produce critical evidence, but Nairobi has balked. This is the key question – what will the ICC now do? Will it throw up its hands and dismiss the case? Or will it bare its fangs and strike at Kenya in which Mr Kenyatta would be collateral damage? If it does the former, and walks away with its proverbial tail between its legs, it risks an existential crisis. If it does the latter, and forces Kenya to cry uncle, it may be seen as overzealous in Mr Kenyatta’s case.

I think it's odd that an American university would let someone step down in the middle of an academic year. Teaching staff usually step down/retire/resign in May/June when people break for summer.
