What if the court rules for a re-run based on tallying issues etc? Will the same IEBC oversee it?

Yes, unless the constitution is amended. The only body authorized under the constitution is the IEBC

Then this is an exercise in futility. If the court rules for a re-run etc, then they are also saying IEBC was complicit.

The petitioners seek to paint a gloss picture of failure, how do they prove that the gadgets that attempt to reach the server fail before transmission?

Data was received at IEBC the rate of success only they can verify. As their lawyer has stated, they gave in some evidence. Well, its now up to the petitioner to prove that no data was received and indeed the system was set up to fail.
