High Court gives its much awaited advisory opinion on the election date.
Three-judge bench comprising Justices Isaac Lenaola, David Majanja, Mumbi Ngugi is delivering the verdict. The constitution in article 101 states that the election will be held on the 2nd Tuesday of August every 5th year of the term of parliament. However, the same constitution states that the current parliament will serve its unexpired term.
..."Wewe ni mtu mdogo sana....na mwenye amekuandika pia ni mtu mdogo sana!".

December if they are sane enough, citizen yesterday showed the chronology of events that must take place before the elections are held clearly August is not tenable!!!

Its High court not Supreme court.

The Elections will be held in March 2013 based on the advisory of the High court.

why not December 2012?

very long judgement but clearly well researched....Biggest loser is Nyachae with his August date...IEBC must be smilling - they have the mandate to determine exact date of election after dissolution of parliament by coalition partners or after expiry of current term in Jan 2013 - date must however be within 60 days of either of the above events...

Atleast someone have showed Nyachae and co. that they also understand the constitution. The latter has all along behaved as if he and co. are the cornerstone of legal knowledge in Kenya. shame on them.

I'm for good, well planned elections whenever the date and at least the Hague tensions would have cooled down.

I think RO would be the biggest loser if elections are March 2013 as he's losing numbers with every passing day.

2013 ruling is good for IEBC we don't need rushed planning. Let them have all the time so that they have no one to blame if they screw up

Is it true? Then they have seen far. There is no reason to change the constitution then if August 2012 was too soon. The next one will be in 2nd tuesday of August 2018?

planning is good but doesnt the constitution explicitly say that elections will be in august. clearly with this kind of uncertainities, you dont expect our markets/economy/investments to improve.

NKT!! Some people hated me here when I criticised the Committee of Experts. These arrogant fellows would not listen to anyone who voiced opinion on such flaws.

March is a long way off but maybe this may herald a time of reduced politics and more economic growth(for a while)>

I want to see how the NSE reacts to this.
