If this can happen to the first family, sembuse the rest of us. That is why I really shy away from land deals.

Haiya!!! If the kibakis can be conned... who are we???

BTW, the question is whether the 'seller' thought no-one would raise hell if the buyer was kibaki's family...

Kudos to somchand & his/her lawyer...

So, even having a lawyer do a title search is not foolproof to conning.Lawyers should start guaranteeing their work, if the search ends up bogus, they are held liable...

@kenstat and others,

A search is just a confirmation of the ownership of the land and status of the same by the government. In a case of impersonation of the real owner by way of fake title and ID, then governemnt can't be blamed. However, the onus is on the buyer and/or their lawyer to confirm the authenticity of the title by other means other than the search. I normally present a copy of the title of any land am buying to the registrar to confirm that the title ain't fake. Take care.

Most frauds these days are done by people with fake IDs.So after doing your search on the land, search the person and let him give you a thumb-print on one of your documents

Be careful

With Land, due diligence is a must. The lawyer you pick for your land transaction can "make" or "break" you. Fortunately, the first family has now picked Mombasa's most higly regarded real estate lawyer/law firm.

I'm not sure I would not blame the goverment in case someone uses a fake ID.The process of verifying the title and verifying the owner would ideally be linked, so you check both in one go.Otherwise, serikali is implicit in the fraud, even though indirectly, by saying owner identification is not their problem. After all, they are the issuing authority for IDs.

I like your suggestion for checking with the registrar the validity of the title. The scary part is, if the conman ako na mtu Sheria house, I have nowhere to hide! I'm still vunerable.
