Hi Wazerians! Thanks for the resourceful information from u all (esp. pablo & co) Am an amateaur in real estate and keen to invest along mbsa road, but so scared to poteza my hard earned chapa.. Am abroad and seems the way out is to buy (from private seller??) via a friend or brother then transfer later. How do i go abt it to avoid squabbles- e.g they use the title deed to secure a loan etc (or worse still losing my kaplot!). And what are the cost differences/advantages in building on red soil Vs. black soil? Which areas in nai outskirts have red soil? Tips please.

Brekke, first and foremost you must if possible come do it yourself, if not complete trust is requisite if someone deals on your behalf. About red or cotton soil, your preferences of location will greatly determine. otherwise red soil is cheaper to build on all other factors remaining constant.

Thanks for the replies. Am interested in an 1/8th, Katani area and athi river. Anyone who knows the security situation around there? have found one in katani and am still not sure whether to buy thru someone else. If not then i may have to wait til maybe april nxt year.. of which i hpe prices wont have skyrocketedSad

Lets say, land deals are very tricky... if you are going to buy land when you are away, get someone you can fully trust. this someone should be ready to do the ground work himself. Do your own due diligence and let it be thorough. Everything has to go on paper and legal way - use a lawyer... its a small price to pay for your peace of mind. I am sure you would know a good lawyer to do it for you. they will do the search to ascertain it is a clean title (some are issued from river road ministry of lands and minerals). Usually you pay some 10 percent and pay the rest upon receipt of all the valid documents. It can be done, but you need to go purely legal way if you are far.... sometimes when on the ground, people cut corners (cheaper but very dangerous).

By the way, they con you when still smiling with you! And expect the prices to have significantly changed by April next year.

My 2 cents. Heed what @Wendz is saying.Never buy land without a lawyer.

To answer your question, yes, you can buy land under your own name (i have done it myself) even if you live abroad. You need to provide your lawyer with copy of passport/Kenyan ID for him/her to get you a pin # from KRA or something like that.

Your lawyer should also perform due diligence and ascertain that the said land actually exists and the title deed is valid.

Key is to also find yourself a lawyer you can trust with your life (i have heard some horror stories).

The whole process should take you about 3 months but you will sleep well at night.I would not encourage you to transfer land to some relative to "hold" for you till you get back. You might be in for a rude shock.
It's not hard to make decisions when you know what your values are.

Am considering using a surveyor to verify that the plot exists and is of the said size. Or can i do without a surveyor and just use a lawyer? Anyone who knows what a lawyer and surveyor cost? should i also use a real estate agent to be more on the safe side? Any suggestions of trustworthy agents? what is the price difference if u buy via real estate agent Vs private seller.

If you buy one from a reputable agents like Lloyd Masika, they will have done the due dilligence and fair valuation for you. I have experience dealing with them though you wud have to find out what property they are currently selling.

I got several plots in Syokimau/katani border. They fall under Mavoko municipality and are Free-hold with ready title deeds. Price 550 000/= for an 1/8th.
You can have someone view it for you any day of the week.

1/8, Measure it urself. An 1/8 is 505 m2 area. Measure with tape and do simple math to get the area.

What i thot was that a surveyor would especially help ascertain the true land boundary of the plot (size isnt a big deal- can send a friend to go measure it for me). I have heard of cases of contradictions when it comes to what is on paper (at lands office) and what is on the ground in terms of overlaps with adjacent vacant plots. And then, say u build a house and part of it is on ur neighbours vacant plot..
If the chances of this happening are minimal and surveyor costs are high, i can drop the process. Its just that there are so many corrupt land officials plus lawyers who just want their fees and are of no help, and being far i want to play it safest and have a good night's sleep after a hard day's work....

I always involve a surveyor. He charges about 10,000- and gives a certificate of survey. He will confirm for you not only the size, boundaries but also that it is the right plot.

Never rely on beacons, anyone can manufacture them.

Am not agreeing with u on GPS use. GPS has a low accuracy, in fact most of those being used( the handheld)in the market have an accuracy of 12-30m. A high accuracy GPS of around 1m is expensive to buy and also hire for use. Put in labour for the user as they aren't handheld and ts pretty expensive and nt reasonble considering the accuracy. Get a surveyor, a total station is more accurate; +- 2cm. Let him do boundary identification for u.
