The vice president is an officer in the legislative branch, as the president of the Senate. That’s nothing new. She will preside over the next count of electoral college votes.

"The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided" (U.S. Constitution, Article I, section 3). Since 1789, 268 tie-breaking votes have been cast.

Right now the Senate is split 50/50 but dems will control the senate at this time because the VP is president at the senate. She can only vote when there's a tie but if several senators cross the floor then her vote doesn't matter
