Nothing adds up here.

At what point did she withdraw the consent?

Consent can be withdrawn even hata kama umejaribu and the woman notices it is not working or big. It is the woman to decide. smile

That rape. Consent obtained by force, threats of force or deception is no consent.

Consent can also be withdrawn at any time before or during the act.

@Angelica_ann, we all agree rape is anything done that is no_consensual.

What I disagree is a scenario where a woman has consensual sex( likely in this case) but then when their objectives are not met they turn around and blackmail a man. They only give rapists a good name, and they are are a shame to the victims of rape who understand the real meaning of rape as violence.

Yes. Non consensual is rape. In this case, the question that begs is whether there was consent. It could be that she even pleaded with him for other rounds

It's dangerous for men who copulate with their women with consent then get framed for rape when they refuse to be extorted. These things are happening. We have men jailed even for defiling minors when it was all a case of grudges being settled.

The HIV angle in this case paints the accused as a despicable human. Assuming he knew he was a carrier that is.

When I was a bachelor, any lady who come to my house meant consent. (Disclaimer - those were many years ago) Why would a lady visit a guys house especially at night??

How I wish she admitted that the sex was consensual but she is now accusing the guy of deliberately infecting her with HIV. If that were the case, she would attract alot of sympathy.

Consensual sex becomes rape if a person fails to disclose that he/she is suffering from HIV or other life threatening STD (Section 43(3)(c)) of the Sexual Offenses Act

Quote:

43(3) False pretences or fraudulent means, referred to in subsection
(1)(b), include circumstances where a person -
(a)...
(b)...
(c) intentionally fails to disclose to the person in respect of
whom an act is being committed, that he or she is infected
by HIV or any other life-threatening sexually transmissible
disease.

If that is the case then, maybe, just maybe rape is now beginning to make sense.
