Nairobi County now Under National Government

Sonko hands over functions of the Nairobi County Government have been handed to the National Government.

This has been done under Article 187 of the Constitution below.

A function or power of government at one level may be transferred to a government at the other level by agreement between the governments if;

(a) The function or power would be more effectively performed or exercised by the receiving government; and

(b) The transfer of the function or power is not prohibited by the legislation under which it is to be performed or exercised.

(2) If a function or power is transferred from a government at one level to a government at the other level;

(a) Arrangements shall be put in place to ensure that the resources necessary for the performance of the function or exercise of the power are transferred; and

(b) Constitutional responsibility for the performance of the function or exercise of the power shall remain with the government to which it is assigned by the Fourth Schedule.

What are the implications?

Omtata will go to court. He will ask under what authority did sonko transfer yet he had been suspended from office by court order? Make null and void he will argue

Will be interesting to see how they go about this legal issue. Sonko should not be transacting for the county

Also, such a decision can be reached without county assembly approval?

Good move. The US govt has its home in Washington DC, the federal capital. Australian govt has a home in Canberra, the federal capital. SA govt has a home in Pretoria, the federal capital. The Kenya govt also needed a home it could own and control, not being a squatter in a county called Nairobi. Now the Kenya govt can develop nairobi to be a world class city that the kenya govt can be proud of as the seat of govt and to reflect kenya as the largest economy in the region.

I hope we have learnt a lesson as Nairobians.On voting day our brains should accompany us to the polling booth.

Meanwhile me thinks this was a calculated move to ensure his supporters eont "bado mapambano" in our streets.Woi his tiny ninio has been squeezed to submission.

So how long will this last? Upto the next elections?

Coz if we know the county govt has no functions left,there will be no need for county seat elections.

If there will be elections, the next county government could want their functions & budget back

I think Parliament is yet to pass an act that would guide transfer of function and gava is fully aware if this lacuna and took advantage of it.

The county still exists and will still be in charge of other function like garbage correction na kukimbiza hawkers

Sonk defends the transfer saying they benchmarked with major cities like washington DC, Abuja and also consulted widely before reaching the decision.

Apparently with an imminent impeachment and a looming by elections the handshake would have been to test and probably the hustlers would have walked away with bragging rights.
The situation had to be contained.
