All she is saying is that she is angry that Ida dragged her kids into a case against the daughter inlaw and that is why she wants to join the case to protect her kids reputation and clear the air that she and her kids have nothing to do with the legal fight between the two.

Being an interested party doesn't mean that you want your cut from a dispute. It's just like if some stranger "sold" your plot huko dustbowl to a 3rd party and then the buyer sued the conman. If you come to learn that your plot is the subject of discussions in court, you'd file to join the case as an interested party for the sake of your property and to clear the air. That doesnt mean that you want any money from the conman or the buyer rather you just want to set the record straight that the plot is yours and the people fighting in court are strangers to you and have nothing to do with you and your property. Likewise this lady's kids were mentioned in Ida's malicious court case and the lady doesn't want her kids dragged into the matter and that is why she wants to join the case and clear the air. Note that she never asked the court to allow her kids inherit fidels estate rather she only wants to clear the air and protect her kids reputation. If she wanted the kids to inherit fidel she would have filed a separate independent case expressly requesting that, not joining Ida's case. Also note that her workmates have been quoted as saying they are not aware of any relationship with fidel and they doubt if fidel is the father to the kids.

The case before court is about letters of administrations for the late Fidel's estate. The grant is opposed by Mama Ida and Winnie because they also want to be appointed as Trustees.

Akinyi is enjoined as an interested party because she is invested in the outcome of the court decision. She is not just a bystander or "a friend of the court". Her twins might be declared to have an interest in the late Fidel's estate. She might also be appointed a joint trustee/administrator of the estate.



The law only provides for the wife not mothers sisters or mpangos. If the twins are Fidels, the court will rule that they benefit off the estate. Hio tu.


Read sections 58(2) and 66 of the Law of Succession Act.

The widow has priority but the court has discretion.

Fidel didn't register a Trust when he was alive but a Trust is created by operation of the law to administer his properties for his children.

According to the succession law, the widow takes over her dead husband's estate, irrespective of whether the estate includes gifts or laundered cash from the deceased spouse's parents. So Mrs Fidel should take over 100% of Fidel's estate. Ida and baba should keep off Fidel's boma.


What if he had nothing registered in his name? We all know he used to operate from his father's handouts so there's a chance he owned nothing.
