It doesn't matter coz registration was only stopped within kibera constituency and he was free to register elsewhere, which he did in starehe. The current law only says that he should be a registered voter in kenya, not a registered voter in kibera. The problem would have been if he registered in kibera after registration had been suspended and thus his registration would have been void. Just because kibera is having a byelection doesnt mean that voter registration is closed for the whole country. As per the law mariga was a registered voter in kenya when he presented his nomination papers.

You are deemed to have been registered once you are given the registration slip that acknowledges your registration. Just like we were considered as registered for huduma number when we were given the huduma registration slip. So all the other IEBC maneno of gazettement, putting your details in the server etc are IEBC internal data management affairs and do not in any way affect your registration status/card/slip.

Regarding Okoths wife no 2, she is a jubilee nominated MCA and thus should be supporting the jubilee candidate.

As long as one has a VALID ID, matters of age are a non issue. After all the only requirement for an ID is to be OVER 18yrs. So you can apply for your ID at 18yrs, 20yrs, 35, 50yrs, 90yrs etc. Therefore those trying to link ID serial numbers to age are wrong. You cant stop one's candidature by disputing his age on the ID.

Both the legal and ICT teams advised the commissioners that Mariga, should not be cleared because he had not been duly registered.

The two teams explained that Mariga, who had not been registered previously anywhere, dashed to Kariakor on August 26 where he applied for registration, nearly two weeks after National Assembly Speaker Justin Muturi had declared the seat vacant.

According to section 5 (1)b of the Elections Act, all electoral activities including voter registration must stop upon declaration of a vacancy.

"Mariga applied for registration on August 26 after the vacancy was declared on August 14 and IEBC gazetted the by-election on August 16, two days later. By law, the application must be brought to headquarters and all details confirmed before they can be put in the voters' roll. Once that is done the register will have to be gazetted.

"In this case, Mariga's application is still pending. He cannot, therefore, be cleared to vie," said an IEBC official.

You are deemed registered once you are given the voter registration confirmation slip. There is nothing like a pending voter registration application.

You are confusing registration with voting. For voting one has to be in the gazetted voters roll. Mariga is not interested in voting in kibera so he doesnt have to be in the kibera voters roll. The requirement for him to run in kibera is to be a registered voter in kenya and he is registered.

You are wrong. And even if you were right, there is no problem coz IEBC can be forced to gazette all "pending registration applications" as you are calling them. A citizen should not be denied his or her rights just because IEBC is lazy. Infact IEBC should be gazetting all new registrations within 24hrs, that is why they have been hired as full time employees.

Voter registration is a continuous activity and therefore the register is always changing. Mariga is in "a current register of voters" but the returning officer consulted the old 2017 one. Infact all his (mariga) details and biometrics are in the IEBC servers.
