I think this case should harshly be judged in order to act as a deterrent for such crimes in the future.
I hope a good female judge will listen to the case.
Ni hayo tu kwa sasa.

What if you admit to Dinner at the Y, nyonyaing Brookside and the lady tumaing salamus halafu mkalala. Is any of these a crime? You can deny that there was ever any entry. Legally, how is entry verified? How many hours after the incident is it possible to prove entry?

Kuna charges for indecent act like touching airport of a minor.
If deposit then proving entry is very easy and definite.
Ukilamba Lolo pia it's a crime and it can be proven easily.

If the girl was in love and consented to the relationship then I would just dismiss the guy for tabia mbaya of succumbing to temptation but I would not recommend any jailtime or haribia him his name. I know the girl is 16 but we know that some girls mature really fast and in some countries including some states in the US the age of consent is 16 even though they can't vote till they get to 18 and can't drink till 21.
If the girl says she does not feel anything for the guy and he attacked her, held her against her will and raped her then I would recommend the maximum penalty.
What I would not want to see is to prosecute the case based on the emotions of the parents. If I was the father of that girl I would want to strangle the guy to death with my own hands but this would not be the right thing to do.
Ask the girl. Most of Kenyans born before independence were born to mothers who got married before they were 18. There is no need to criminalize human nature.
the relevant law is the kenyan law not of 'some countries including some states in the US'. what of this inferiority complex of some kenyans always thinking that our laws are inferior to others and we must always look at the latter to belittle ours without any cogent reasons?

I have to admit it is more of ignorance than belittlementm. What is the age of consent according to Kenyan law?
