The 1st applicant alleged that he is aged 60yrs old and suffering from high blood pressure and hypertension thus requiring medical attention outside prisons owing to lack of sufficient medical facilities in the prison where he is being held. No medical records were attached to support that claim.

It has not been established or proved that the ailment is not manageable within the hospital facility. In any event, nothing stops prisons doctors from making a referral to hospitals like Kenyatta if the situation demands.

As regards age, in this case 60 years for the 1st applicant, that perse is not an exceptional circumstance since at that age people can still be active in life including working in civil service unless the sickness is age related which is not in this case.

His like all deaths are unfortunate but the decision of the court then sounds right to me, people die everyday. The average life expectancy in Kenya is 62 years?

All the same, may he rest in peace

Kwendeni huko. John Gakuo was a criminal. Who was found guilty by the laws of Kenya. If Judges start releasing every criminal because they are 60 years old, why not release the 28 year olds because they can be more useful giving birth.

It's not good to celebrate the death of anyone. Even criminals. However, thinking that the Judge had anything to do with his death is stupid.

Why don't you ask God why he took him when he did? Blame God or Satan..Not the Judge...Ara?

@alma1 I think you missed the KQ flight to New York. In Africa, the dead are treated as Holy Saints - including rapists and robbers caught and killed while in the act.

Surely, how can someone fault the judge! Gakuo should have gone through the prison doctors like Obado or PS Omollo.

Justice can only be found in heaven, I do believe that administrators have the overall responsibility to decide on the best cause of their institutions. However in doing so they should always seek a second opinion on the technical matter at hand.
I would like to know what the value of the property in question to date. Secondly, what other better user would you have put land overburdened with black cotton soils into, if not for use as cementry. In any case it would have costed the nation lesser in overall in rehabilitation to suit the land for use as such rather for building purposes.
For due diligence, thus a talk I would like to have in person with the individual concerned another day.

- actually every officer vauching the document had a duty of care to the employer with respect to authentication of the documents, and if not aunthenticatable, notify the employer by way of cautioning. The seller, had an opportunity to defraud. The problem is, putting the seller on the table for falsification of information.
Bid bonds cheques ought to always be banked, bank bid bonds should only be delivered by the issueing bank. Otherwise, the judge will always put the blame on you for system failure. Ascertaining genuinity of a tender is hell, I can not dare imagine I have always not done this, morotov concoction for my old age.
Someone with this case number share, I need to up-to-date with cutting crossing cutting issues.
Am shaken to the core on rereading my own above post.

Gakuo died serving a term for cemetery land fraud. Gakuo means death. The irony!

That headline the in the standard says it all "Man who changed Nairobi dies in prison"
The irony of it all the ones who messed it up akina Zippy wandera, the ones who supplied chalk instead of chlorine, the ones who stole the mayor's golden chain, the ones who grabbed the public utility plots got away with it. I'm sure even Kidero will go scot-free.

Even if i say the truth here, about what happened, it will not change a thing, it will be lost in the sea of noise.
I know Wazuans are learned people, connected people.
Go read the procurement laws of the time.
Talk to your friends in the know.
Read the court proceedings and you will know the truth.
I am sad as i know the truth yet I have realized the truth cannot set you free.

I leave with a message i will paraphrase from Icharus.

In the fight against corruption,
You cannot be 50% honest.

You have to be honest,
Or you have to hide the ends.

It’s the same as Orwell, 1984

Corruption is like a religion,
And you cannot escape.

You have to think about money,
But you cannot steal money.

It’s like being married.
You think about other women,
But you have to remain married and but you want to sleep with other women.

But again almost everybody at some period in their lives sins,

So what to do?
There is no answer.

Rest in peace Gakuo as I know you did not steal the Money.

Rest in peace John Gakuo. When old men die in prison, the cities are dying.
