It was the first time a supreme court has nullified the election of a sitting African president.

On Tuesday Mwilu was arrested.

On Wednesday she was arraigned on corruption-related charges, including abuse of office, failure to pay stamp tax, improperly obtaining Sh12 million from the troubled Imperial Bank, obtaining security by false pretense, among other counts.

She did not take a plea and obtained a court order suspending the criminal trial until October 9, pending determination of weighty issues.

Much as I have little respect for the Sub Standard, I cannot but marvel at the brilliance they are throwing at this saga.

By the time this issue comes to rest, numerous cans of worms will have been opened regarding the manner in which The Njumbiri Government and Kenyatta II Regime is (mis?)managing Justice affairs in Kenia.

A silent stand-off between President Uhuru Kenyatta and Chief Justice David Maraga could have unwittingly set in motion the criminal prosecution of Deputy Chief Justice Philomena Mwilu.

Reports indicate there were concerns that a referral of Mwilu's case to the Judicial Service Commission (JSC) would have prompted the DCJ to excuse herself, occasioned a quorum hitch and effectively stalling any further proceedings against her in the JSC.

JSC is tasked with investigating claims of misconduct against judges - and recommending their removal from office if necessary - as was the case with former DCJ Nancy Baraza in 2012.

The Standard could not authoritatively link the Uhuru-Maraga stand-off over the swearing-in of new JSC commissioners to the current case.

However, there are subtle undertones. Senior Counsel Ahmednasir Abdullahi yesterday told The Standard the JSC would face a constitutional hurdle of lack of quorum if Justice Mwilu stepped aside.

“As it were, if Justice Philomena Mwilu goes back, they will have a quorum but if she vacates, the JSC will be paralysed,” he explained.

Were a petition against her to be filed at JSC, Mwilu would inevitably have to leave any further proceedings on the matter.

Lawyer Moses Kurgat said there was a danger of JSC’s decisions being challenged in court if it does not have the requisite minimum number of commissioners.

“In my view, this is a commission that is mandated by the Constitution to have a quorum.

If it does not have, it cannot carry out any constitutional mandate and its decisions can be challenged in a court of law,” Mr Kurgat said.

Hahaha oooh, yes! Nothing against Lady Justice. The DPP is not smiling,so hapa kuna jambo hata kama NASA yote iko huko representing her. I have heard many saying it is digging dirt, dare I say that if that is the case, they went digging and they found it. She and all others who sit in the highest court in the land should be above reproach.

Orengo and friends are of the opinion that if you take a loan and refuse to pay, you are not liable for a criminal suit but commercial dispute.

However, from what I gather from what is out there, this was no loan but a "gift" either to kill the imperial bank "fish business"case or something. She received that gift while she was a judge at the court of appeal.

I hear she is also charged of forging the withholding tax slip and presenting it to the ministry of lands

Of course anawalipa. Malipo is keeping the Senator for Busia happy. All those lawyers are there for the Senator. She is not the kind that has any friends. Senator ndiye ameshikilia and I know for a fact he has friends everywhere.

Damage has already been done. She has appeared in court accused on matters of integrity, nobody would want her on the bench hearing a case. If a case goes to the Supreme Court, the first thing the lawyer will do is seek for her to recuse herself as she cannot be trusted to render an uncompromised judgement.

But seriously, could you phantom a black Kenyan taking a big loan from Imperial Bank?

I still don't think this is as serious. Her position is what is makimh this case interesting but there are a thousand more serious crimes committed by other 'public servants'... From this article, she actually paid up the loan after selling the property, I was of the opinion that she sold the property and pocketed the cash. We can agree that this is a semi witch-hunt if we are to call it anything.

This will not age well for the person in the subject matter.
One of the lead lawyers is retained to execute 'The Gideon strategy'.

-the lawyer's 'counsel' birthed the outcome that was 26th Oct 2017.
- and is on something akin to plea bargain himself.

-takes orders from, and is on payroll of a house near Caledonia.

As for the strategy: '...by deceit we shall wage war'
