If you hire an engineer and contractor to build you a dam, then it collapses, who should take the blame? The engineer and contractor of course. They should even compensate you for the millions you poured on the project. Infact the contractor is required to have insurance to cover any damages emanating from his works. In this case the contractor should pay Patel and all those killed or injured. The engineer and contractor should also be de-registered from their professional bodies.

http://www.markham-group...tractor-have-insurance/

In the old days (ancient times) architects, engineers and contractors who built bridges were forced to stand under the bridge when it was being used for the first time so that they could pay with their lives if it collapsed. For domestic houses, an architect was required to surrender his son to be hanged if a clients house collapsed injuring his family. These measures ensured quality workmanship by professionals.

Not always. Sometimes there's nothing wrong with the engineering but negligence by the owner after and who knows if they even used a certified engineer or quarks? So let's go the Kenyan way and commission 'speedy investigations' and dump the files in the dust pile.

Patel probably has each and every politician in Nakuru in their pockets. And I mean all of them. I saw all of them on TV talking about "natural disaster" due to heavy rains. So you know where those "investigations" are going to end.

What is shocking is that the very people who were harmed by Patel will be same ones who will "kumira kumira, mundu witu" in 2022.

Patel builds 6 dams denying them water for years. They are the ones who will tell you that Patel is good since he gives them "free" piped water.

Why should you feel sorry for such people? They seem to love the cookie that's been handed to them.

Masukuma's model of voting for one's own interest is what these people need. But they will corrupt their need. They will end up "needing", charo nefa mbe. Their true needs are right there. They will instead see the needs of some miraculous fella who shall save all of them together.

Sad..But...that's things work in Kenya.

Anyway, whats the latest on Miguna? We need to move on from this story chap chap...Too much misery affecting these poor people.

I feel sorry for them because they don't know better. The system has always worked to keep them poor and desperate for hand outs. I hope they are educating their children because that's the only hope they have.

They dont know better?Sad

This is mere negligence and patel should be behind bars. There had been written warnings about that dam, he did nothing. Don't blame God / devil on this one!

For a long time I never used to understand the moniker hardwood. Now I do. Grammar please. I do.

My fren

Uliza Masukuma. He probably comes from the same sort of issues.

Charged by who? Uhuru Kenyatta? You do know that there has never been anyone charge by Uhuru for anything. Every day he's on TV he "warns" all the corruption to die or something like that. As a voter, I'm still waiting for the day he'll be serious. oooppps raira charo nefa mbe.

I'm here to tell you this.

Koigi Wa Wamwere was removed because of saying Patel will kill people. Why? Because everyone in Solai eats from Patel. 15 votes just coz of telling these people, that they were going to die. Now they are dead. Corruption will kill you. That's why people like me have moved to magufuli.

Umeskia?

Patel can drink your blood but the motherf***er built the house for the OCS. Uta du war?

I keep on telling you. You are stupid. But you keep on telling me..Raira charo nefa mbe.

I have seen a gov't paybill number. Nitatuma shirigi biri.

This has nothing to do with dam water. This is natural rains killing.
Post a link where a KenGen dam ever broke banks and killed people?

Those are built with all safety measures in place lakini Patel ni nani?

No....Kengen purposely lets out water from the dams to the Tana river and the gust of water goes killing and destroying property downstream, that does not sound like a natural phenomenon to me. Patel's dams have been there for 20+years those govt officials saying that they talked to him about the dams should show documentation verifying this. Infact the regional coordinator doesnt seem to believe them because he was never informed of the visits. Its time GOK starts firing these lazy bums earning salaries without working WARDA NEMA are useless offices.

KenGen has always given 24 Hrs notice before spillovers to Red cross and Garisa resident's( but this year 2018 April Kiambere dam spilled over without a whisper from KenGen)

FYI Masinga dam is almost but not yet full. If a KenGen dam (7 forks) ever bursts you will be lucky to get anyone alive in Garisa and Tana delta

For something to happen someone needs to do some leg work. One way of doing this is to follow the legal channels but it takes a lot of work. If there are real lawyers who care about justice this would be a perfect case.

Collect all media coverage of the events both print and digital.. I would even go further and collect all raw footage that never made it on air.

Send a few people to Solai to interview all people affected. Relatives who lost loved ones, people injured and in hospital, people who lost properties. Well written sworn affidavits.

Start collecting local information on everything about that dam. Contractors, engineers, interview everybody who ever worked on that dam or on the farm.

Go to any government office and all information from everyone who ever made any communication with the owners about the dam. There is talk that the owner was advised to legalise the dams but he ignored. All these correspondence from any government agency must be collected. All reports by the local people either to police or to whatever authority that made any reports should be collected.

When you have all this information you need to retreat for a very long time as you build your case. Wait until things have cooled down for even one year. When you have all your facts and a mountain of evidence look for Judge Odunga and start suing: you will be suing Patel and all government agencies involved.

The details may not be exactly as outlined above but the point is you can never make a case effectively without evidence. Kenyans are the laziest people when it comes to gathering evidence because it is a lot of work. If you do your homework and put in the hours there are judges in Kenya now who will be willing to hear you.

What is to legalize a dam? And why would you go to the high court in Machakos and not Nakuru?

The body that can approve or disapprove an existence of such a dam is Nema, if they approved knowing there are issues with it they and only they can be sued, otherwise even Patel is innocent, he was solving an environmental problem

Wrong. Start with the county GAVA, then NEMA and Next is WARMA, and finally County GAVA. Our systems are just wreckers and casual, the society is skeptic and not willing to be watch dogs for simple reasons as nepotism and Kukulia. A day when we care for ourselves first and then our neighbour is replaced with we ought to care and are responsible altitude, none of that will ever happen without a genuine cause.
Pointing an accusing finger on the designer, contractor and operator.
Designer-never cared to buffer up end edges of the earth dam. Never issued a do not operate warning before back face is stable and protected. Thirdly, that soil is not compacted and unbending.
Contractor. Never protected the walls. Allowed operation before setting and stabilization. Everything looks so recently and freshly made.
Owner. Too greedy. Was just eager to collect every drop of the on going rains. Ref, Devil on the Cross, harness every drop of oxygen and meter to the dying souls and be rich ever after. Without prejudice.

The farm is not in any municipality (if you know what that means) and the dam has been there for over 30 years. So blame game lies squarely on Nema and that water authority

Quote:
Former former Subukia MP Koigi wa Wamwere yesterday recalled how he fought but lost the battle against the construction of the dam, when he represented the area from 1979-1982.

"He [the owner] was blocking water from reaching neighbours downstream and people from passing through his [Patel's] farm, although they had no alternatives," he told the Star yesterday.

Koigi said that although they have been inconvenienced by the dams, residents were grateful to the the farmer because of the benefits to them from his community service.

The view was shared by former Kenya Civil Aviation Authority boss Chris Kuto, a neighbour, who called Patel "a very responsible person". He said the tragedy could not have been the result of negligence.

"We have had enormous rain. Even my farm was almost washed away last weekend," Kuto said. "I have lived here for years and I can only compare the current rain to what happened in 1961. It filled up to the hills."

This has nothing to do with dam water. This is natural rains killing.

No....Kengen purposely lets out water from the dams to the Tana river and the gust of water goes killing and destroying property downstream, that does not sound like a natural phenomenon to me. I saw the notice given before Kiambere spillway was opened It was about 36h earlier. A scanned copy of the notice was "all over WhatsApp groups".

I can understand your anger @muchr; but the opening of dam spillways is done willy-nilly. They are only opened when they fill-up in order to release water in a controlled manner and with notice given to downstream residents.

If KenGen doesn't open the spillways, the dam will overfolw and put the structure at risk of fracturing....which would lead to a major catastrophe.

If Kiambere fractured the entire Garissa town would be washed to the Indian ocean! Everything! Nothing would be left standing in that town!
