No, the corect position is; - As at now the matter of his citizenship is contested, disputed by the Govt of Kenya.
There are two views, his and Govt's.
Only the courts can rule one way or the other.

He needs to enter Kenya to carry out his business some of which is litigate over this matter.

To enter Kenya he can;
1. Use his Canadian passport
2. Apply to get a Kenyan passport - and the process is laid down as told to him by the Immigration.


So we trash the court orders?

I am not persuaded that there are any Court orders that compel the Govt to issue him with a fresh passport.

A very broad&liberal reading of what you posted up there might be misconstrued to mean so, but I have other 'ideas'

And to add to that, if my memory serves me right at one point the Court ordered that the passport be deposited in Court pending the hearing.
However 'unfortunately' the passport showed up perforated.

From then on, if the Court had wanted Miguna issued with a fresh (un-perforated)passport, nothing would have been easier than saying so.

That passport was acquired illegally and the courts must not be used to perpetuate an illegality. Miguna cannot hold a valid kenyan passport until he applies for citizenship and he has refused to do so today.

@Ngalaka if court issues court its order on one hand and the gava insist on interpreting in its own manner on the other hand, where are we heading? Are we saying we are a failed state?
