Here is the government’s full statement on Miguna Miguna’s Citizenship:

Political activist Joshua Miguna Miguna was last night deported back to Canada based on the provisions of section 33(1) and 43(1) of the Kenya Citizenship and Immigration Act, 2011.

Miguna fled Kenya in 1988 using travel documents provided by a foreign country. Thereafter he acquired Canadian citizenship and has remained a Canadian citizen since then.

Miguna acquired Kenyan passport in 2009 at a time when it was illegal for a Kenyan to hold dual-citizenship without having denounced the foreign citizenship.

Prior to this, Miguna had applied for Kenyan Passport in 1987 to enable him travel to Cuba for a students’ conference.

His application for passport was rejected in a letter dated 12th September 1987 which gave Miguna reasons for the rejection. At the time Miguna was a students’ leader at the University of Nairobi before he was expelled from the University.

Under the repealed Constitution, Kenyan citizens were allowed only one nationality. Kenyan citizens who acquired other nationalities automatically lost their Kenyan citizenship.

When the new Constitution came into force, Kenyans who had lost their citizenship as a result of acquiring other nationalities were required to officially apply to regain their Kenyan citizenship.

Miguna never did this and therefore continued being a Canadian citizen.

In 2009, Miguna made an application for Kenyan passport at Kisumu Passport Control. Without following the requisite legal process, then Minister for Immigration, the late Otieno Kajwang’ ordered that Miguna be issued with a Kenyan passport.

The late Minister’s orders that Miguna be issued with a Kenyan passport without following the proper legal procedure as prescribed by law was illegal and had no backing in law.

At the time Miguna was unlawfully issued with Kenyan Passport he was working as an advisor to then then Prime Minister Raila Odinga.

Prior to being illegally issued with a Kenyan passport, Miguna had been travelling using Canadian Passport No. MJ 393885 and WK 944502. Miguna renewed his Canadian passport in June 2017 just a few weeks to the general elections.

When Miguna acquired Kenyan passport in March 2009, he deliberately failed to disclose the fact that he had acquired citizenship of another country and therefore the Kenyan passport he acquired then was and still remains illegal.

Before the new stupid katiba, there was no provision of dual citizenship. Therefore when miguna took up Canadian citizenship he automatically lost his Kenyan citizenship. After the new katiba, him being a Canadian citizen, he got a chance to regain his Kenyan citizenship but this was to be done through application. He never applied and therefore he remains a Canadian citizen. Now, even if he applies for Kenyan citizenship he won't get it because he is a Canadian mercenary who has committed a capital offence against Kenya. Also the govt should confiscate all his property in Kenya, including his house at 486 Runda meadows since he is an enemy of the state.

I love the way the ministry statement uses the words "illegally", "unlawfully" etc without any shame.

They do realise that by they themselves not following the law in such matters, they are committing an "illegality"?

I can see why they would like to twist and turn around this issue. Sorry, things don't work that way.

It was not Otieno Kajwang who issued Miguna with a passport. It was the gov't of Kenya. Unless, they are saying they don't recognize the gov't of Mwai Kibaki. Which is strange considering they are complaining Raila doesn't recognise theirs.

Even for the worst criminals like the Arturs, the law was followed. To the letter.

Ever since this gov't has refused to follow court orders, I hear even KQ has refused to follow court orders. It is a slippery slope my friends.

When court orders are taken kama karatasi ya kufungia nyama. Soon even your neighbour will refuse to follow them. It is not a matter to be taken lightly.

I am 100% sure that the very same gymnastics shall be used on someone in this very gov't very soon. 100% sure. Ask that cop katitu who thought by shooting people because he was told you by some upper ups he shall go to heaven. He was found guilty today for killing people.

All those people who use to kiss ass in red ties, red shirts and cockerel lapels ended up nowhere.

Alma you should be using your brain sometimes. The govt has a right to cancel any passport, title deed, permit, license etc if they discover that it was issued fraudulently. Kajwang was notorious for hawking Kenyan passports so you can imagine that baba's adviser miguna would have gotten his illegal passport at lightning speed. This kajwang should be tried posthumously for all the sins he committed against kenya. That is why baba and his lieutenants should never get into power ever again because they are very corrupt thugs.

The Govt of Kenya has a right to revoke your passport if you obtained it illegally

In 2011 the issuing of visas/permits was questioned here in wazua. So its not foreign or out of this world that Miguna's passport was obtained fraudulently.

The executive arm of gov't cannot declare anything criminal. That's the work of the Judiciary. It has to follow the laws on illegality or otherwise suggested by the legislative arm.

That is why the police write a charge sheet then you are taken to court. Then the court decides that a crime was committed. Not hardwood and murchr pronouncements on social media. That is why Waiguru became a governor even after all the noise on wazua. She was never charged for any crime. Kapish?

Please advise on which court case Miguna's passport was ever declared illegal. Please take your time.

As you think about that, please give us details to us where a Minister of the Gov't of Mwai Kibaki was arrested or charged for giving out false papers.

Please note wazua gossip is not counted in serious matters of illegality or otherwise.

You can't have your cake and eat it too. I'll tell you once again. Someone is going to go through the very same gymnastics and it won't be whom you think.

The laws of Kenya declare what is legal and not. Its the work of the Judiciary to interpret this if you do not understand, and its the work of the executive to enforce the law.

People go to court to object to enforcement of the law.

The laws of Kenya declare what is legal and not. Its the work of the Judiciary to interpret this if you do not understand, and its the work of the executive to enforce the law.


Don't tie yourself up in knots.

The laws of Kenya are created by the legislative arm. You do know the meaning of legislature.

Do not even for a minute bring up the issue of certificates prochuad from a university. You get that certificate based on the laws and bylaws of that university. And those are interpreted by the senate council of the university. Not by the lecturer who gave me a D-

In Kenya you are judged based on the laws that are based on the constitution. Supreme amongst them is that no one is above the law. Especially the law enforcers. Note: not interpreters on Twirra or wazua. But the goddamned courts.

I'll leave this stories as I have a very long 2 weeks ahead in my life. Unless hardwood brings a contigent of armed cops to my house to state that I'm not even human.

People go to court to get their rights. They expect everyone to play under the same rules. When they find out that the same rules don't apply to anyone, start typing "banana republic".
