When Anyona and Prof. Ngotho Kariuki were arrested by special branch in Dagoreti, the state had all the legal instruments to do so. The public order act, heck, even detention without trial was legal.
30 years later, trying to recreate the same scenario is an extremely frustrating and futile endeavour.

I am beginning to realize this problem of "kusomewa katiba" is much bigger than i thought. After the kijiji fire in Langata last week, the governor of Nairobi "directed" the national disaster management team to commence investigations immediately. I follow Sonko on facebook. Hundreds of his supporters congratulated him for the prompt action. I have made peace with the fact the IQ of the average sonko supporter is dangerously close to retardation. But I was expecting at least one to point out, sir, don't you mean "requested".
When I see the usual suspects in a celebration dance over an order to repossess NYS land, I am left wondering through which law. There is an independent commission that does that. Its called the NLC. Corrupt as hell but we are stuck with them. Of course Farida Karoney can revoke the title deed. And then a high court order would overturn her decision. By then the supporters for whom the cosmetic 'repossession" was intended would be gazing at another red herring. Memory of a warthog.
Make no mistake, I would love to see all public land repossessed. The Ndungu report has the full list. Kibaki looked at it and it made his stomach turn. If we were to act on that report, Jubilee and KANU would be over in a matter of weeks.

Is anyone else surprised at how Orengo has kept himself clear of all this drama. He is there in all the pictures but did not participate in any way, he did not sign any documents or administer any oath. Very sly cat.

The law guiding the process of taking over the instruments of power is quite elaborate. It was followed to the letter to swear in Uhuru. Baba's oath has no legal backing. I called it a comedy. Most kenyans including those at Uhuru park understood that. The only people who are taking it seriously are Jubilee supporters. And the government. Makes one seriously doubt Githu Muigai's legal mind. But lacking legal backing is not the same as being a punishable offence. Let me give an analogy here. Suppose you and @hardwood started living together. Stay with me please. Your new union has no legal backing and it would not qualify to be called a marriage under Kenyan law. But nobody can arrest you for committing a crime. The crime under the penal code is having s#x against the order of nature. Impossible to prove in court. Similarly, Baba's oath at Uhuru park meant zilch in law. If the supporters had matched to statehouse carrying weapons, that is when we reach the criminal threshold.
