The 32-year-old court battle for control of the multi- billion-shilling estate amassed by former Cabinet minister Mbiyu Koinange stands out as possibly Kenya’s most intriguing family dispute.

Kiambu Governor William Kabogo’s name has been drawn into the case involving the murder of Maasai land rights activist Moses ole Mpoe.

Defence lawyers claimed that powerful people, some in government, were involved in the murder due to a pending multi-million-shilling land sale.
They said the Koinange farm in Mau Narok was to be sold to the government for resettling internally displaced persons.

Lawyer Paul Muite said one of former Cabinet minister Mbiyu Koinange’s sons, Mr David Waiganjo, wanted to sell the land to Mr Kabogo without the family’s consent. The land would later be sold to the government at an exorbitant price, added the lawyer.

Mr Muite said Mr Mpoe had to be eliminated because he and a section of the Koinange family were opposed to the sale.

Mr Muite claimed that the land was to be brokered through Mr Kabogo’s farm — Impulse Developers Company.

During cross-examination, Mr Muite accused Mr Abdi Salat, a senior CID officer who investigated the murder, of being used by the government to cover up for Mr Waiganjo and his cronies.
Also mentioned in court Monday was Mr Koinange’s other widow, Ms Margaret Njeri.

In the matter, Mr Koinange’s widow, Ms Eddah Wanjiru Mbiyu, her stepson David Njuno and five others are charged with killing Mr Mpoe and Mr Parsaaiya ole Kitu at Soilo Junction on the Nakuru-Eldoret road on December 3, 2010.

Defence lawyers Muite, Gordon Ogola and Wanjiru Wachira asked former Nakuru district criminal investigations officer Salat why he did not arrest two sons of Mr Koinange — Mr George Kihara and Mr David Waiganjo — yet they were mentioned by Mr Mpoe in his statement.

“When Mpoe recorded a statement at your office over threats to his life two days before his murder, he referred to several violent confrontations between him and Mr Kihara that led to injuries,” said Mr Muite.

I heard one too on Eng Maina of Kirinyaga, he was in a meeting somewhere in Nyeri and after he had choppad down, people were heard talkin talkin and he stood up and said mwenye nimetumia siringi yake moja kununua ile chopa ainue mkono.
The saddest/ funniest is when he said he can cook a ndiramu (barrel or whatever they are called) of Githeri with his money mpaka kiive and he will still have more to spend. Not forgetting it was a dry season .
