They will be taken to court tomorrow about telling Kenyans how many people they want on the "fresh" ballot.

They still haven't learned.

Hoping this time IEBC has learnt the lessons. They should take their time and only announce results in day 7 when they have literally seen every form. Aibu ndogo ndogo manenos, ooh forms not signed, ooh scanned form not clear, no water marks etc should stop.

We don ant to see anything on TV screens and only want to hear results.

does it matter, I think they should announce withing the following day, if a form is not signed there is nothing much they can do, if a ro decides to use an exercise book page as the form, nothing much they can do.

I fear that if Aukot is not on that ballot, the October elections are an exercise on futility.

IEBC should take a case to court to clarify what "fresh elections" mean. Otherwise we shall have another charade where their lawyers try explain the words statistics, data, preliminary numbers and form 34A

The court nullified the election which means the elections did not happen.

It is their duty to seek a comprehensive ruling on this one.

Last time they tried to play around the issue of form 34A being transmitted immediately we had a circus which they lost. They should desist from making their own rules then ending up with egg on their face.

They should be the ones to take the case to court kesho and not wait for another 1 week lost in the courtrooms as is just about to happen.

I doubt if IEBC lawyers are serious. I really do.

IEBC lawyers are following a supreme court ruling/submission of 2013

Methinks it’s a ploy to expose the court for not having made itself clear. Dragging each other’s name through mud.

IEBC lawyers are following a supreme court ruling/submission of 2013

Aukot can go to court tho

Murchr, for about 3 weeks, you and other "legal" experts were on this forum quoting the same 2013 Supreme court ruling and talking about numbers.

Maybe you haven't realised yet, the law in Kenya is that the process and conduct of an election in Kenya matters more than the numbers.

Ama you want another Maraga quote.

That's what it is. If your lawyers were honest with you, which I doubt if you have poets and bullies as lawyers, they will tell you. That this court basically called the other court's ruling rubish.

This idea of following emotional bloggers to explain to you what invalid, null and void means should really by now be a thing of the past.

There shall be a court case and the best thing for the IEBC to do, is to take their own case to seek intepretation.

Or how long do you think that Kenyans can go through another merry go round with this commission?

I'm not saying that they are wrong but my fren, they had better have a better meaning of invalid than "statistics" and servers are in Europe and the servers are sleaping.

The matter on who runs in a fresh poll was addressed by the Supreme court in 2013. Link post(s) above.

Aukot and others can challenge that but it remains as law

I also think that politically this was a very bad move. The final ruling has not been written. What makes you think that this whole issue has not been added to the rulings today.

Testing a court is usually not advised. Ask the fella who came up with the silly reason that the court couldn't access servers.

Patience is lacking in this IEBC. They don't even know if the guy who tweeted will be working there when the final ruling is given.

Haki sometimes I think we politic too much in this country. Tooo mash.

You lost. Accept and move on. Give us a credible election then go home. Let the rest of us be. Aii!

IEBC is following the guidelines provided by the court in 2013. The law was not contested and therefore it did not change.

If Aukot thinks otherwise, he can challenge the 2013 submission and a new guide/law will be provided. Wachana na emotions na usome hio document, the various outcomes were addressed including in the event one of the contestants died.

What Maraga is about to release is the ruling in detail, no suggestions on who will be on the ballot. The law does not rule on matters not brought before them @alma...you ought to know that. The issue on who will be on the ballot was never before them

Your confidence in this matter reminds me of a few people on this forum. Including yourself who were busy quoting bloggers and poetic lawyers. Ati numbers, numbers, form 34A etc.

I'm never emotional. I am just suggesting that after a court in 2017 basically ruled and called a court in 2013, korti bandia, you should do everything in your power as a lawyer at IEBC to avoid such shame again.

What if IEBC loses this one? Who will trust them?

Taking a case to court kesho to seek clear rulings based on the new law is prudent and good for the country. Basing arguments on 2013 is what brought us here in the first place.

Anyway, mine is just to watch and learn. You should try do the same.

IEBC lawyers are not bloggers. They should take their job seriously and seek a clear ruling on the same.

What if after wasting another 60 days Maraga says that he meant the election starts fresh? What then? He has already told people that process matters more than numbers. How many times do you gov't people have to be told to be serious with your jobs?

It's because it's my firm belief that most wazua users went to school and read a book in their lifetime.

If you are really interested in short stories, may I suggest Pauline Njoroge, Itumbi, Nyakundi and ItsMutai.
