He was not the only one,majority of the judges were of the
Opinion that the irregularities affected the outcome of the election,so it is not his decision only.
However,I agree with the opinions of the two dissenting judges,the will of the people was expressed and no evidence was presented to warrant over turning that will.

I am very disappointed in you if all that you took away from this judicial process were the tribes of the judges. Sad

I have conflicting feelings about this ...on the one hand, we can't allow complacency in institutions and IEBC and anyone who might have a hand or think of inducing them into irregularity gets a slap in the face...
on the other hand its going to be an economic blood bath.
Either way, I am hoping two things happen:
1 - An election that is above board - beyond reproach
2 - RAO gets handed a defeat which as a result of (1) leaves him no excuses and no recourse other than to retire permanently from politics.

Very sad and likely bias, when ukabila is practiced so openly in the courts, remember the pro-odm judge odunga before elections? the power of other sectors that are supposed to be apolitical and neutral should be managed. It is even difficult in this age of bribes to conclude that no bribes were paid to our judges. A rotten judiciary which cant resole corruption, land cases e.t.c has stuck it fingers into deciding leaders, the powers of this people in election matters should be explicitly trimmed.

Our Judges are canvassed for by politicians and passed by parliament, our politics is tribal, no arguing about that, you favor the side that got you the job, along with it's 41 vs 1 attitude and kikuyu this kikuyu that basic thinking no matter how educated. There is no ethics or justice in some of these places in Kenya, they will take 20 years for a poor mans land case but clear presidents in a week and say they are being "assisted by God". When those who were canvassed for by ODM (read particular tribes) benefit from an imbalance due to death, retirement, sickness, sacking e.t.c of judges on the bench, their is a 'stronger tribal view' among the judges, and judgement, a natural bias to favor their sponsors, power of supreme court urgently needs slashing.

Some questions remain, will there be another tender for ballot papers? Clerks in the polling stations will have to be paid again. How much did the elections cost? Am sure they are going to spend at least half the amount. Schools will close early. How many days does KCSE and KCPE take and when ?? since most schools are polling centers.

People will campaign again and gains will be double double. But They should not count a lot on those MPS because most of them are broke.
